How the LTN barriers were selected

Dear Oxfordshire County Council,

I would like to understand the process by which the specific planned Oxford city Low Traffic Neighbourhood (LTN) barrier (planter / whatever) locations were identified and selected.

Please therefore send me:
a) the first and subsequent drafts of any internal OCC report (s) that drew up and evaluated the planned barrier locations. Please also provide the dates these documents were finalised / circulated.
b) any submissions made by community groups / commercial organisations / other organisations that fed into the LTN barrier selection - irrespective of whether these suggestions were ultimately adopted or rejected by the OCC. I do not need to know WHO at the relevant external organisations made such submissions (i.e. names of individuals). However, I do wish to see exactly which documents / proposals where made by which SPECIFIC organisations. Please also provide me with the date (s) these submissions were received, so I can establish timelines.
c) any evaluation of proposals made by OCC officials of any submissions made by third parties regarding potential barrier locations - including the date of that evaluation. I would be content to see redacted internal OCC emails containing such an evaluation, if that is all that exists.

Oxfordshire County Council does not hold this information as all
evaluation of proposals was done verbally.

 

 

The Council has redacted the following information from the disclosure:

 

 1. The names, addresses and contact details of third parties.

 

The Council considers that this information is exempt from disclosure
under Regulation13 of the Environmental Information Regulations 2004. 
Regulation 13 provides that information shall not be disclosed where it
constitutes the personal data of someone other than the applicant and that
disclosure would satisfy one of three conditions. In this case, the
relevant condition is the first condition, namely that  disclosure would
contravene any of the data protection principles, or would do so if the
exemptions in section 24(1) of the Data Protection Act 2018 (manual
unstructured data held by public authorities) were disregarded.

 

Specifically, the council considers that the first data protection
principle would be breached; namely, that disclosure of the redacted
information would not be fair for the following reasons:

 

 1. The reasonable expectations of the data subjects and the nature of the
information itself leads the Council to conclude that the data
subjects could not reasonably expect that this information would be
disclosed;
 2. Neither this, nor similar information has been released into the
public domain by the data subjects or anyone else; and
 3. That the legitimate interests in the public having access to this
information do not outweigh the interests in preserving the rights and
freedoms of the data subjects.

 

In reaching this decision, the Council noted that the following
consequences may occur if this information was disclosed:

 

 1. Release of this information may cause embarrassment to the data
subjects;
 2. Disclosure may lead to the data subjects receiving unwanted and
unnecessary correspondence and
 3. Releasing this information may cause distress to the data subjects.

 

In light of the above, the Council considers it justified to uphold this
exemption by applying redactions to the disclosure.
