Thank you for your correspondence received on 22 December 2020 in which
you asked for the following information:

 

Please could you provide the current/latest organisational structure for
the Commissioning and Procurement teams, including the names, job titles
and contact details of all mid and senior management.

 

Your request is being considered and you will receive the information
requested as soon as possible and in any event within the next 20 working
days in compliance with the Environmental Information Regulations
2004/Freedom of Information Act 2000, unless an exception applies. This
means that the council will respond to you by the end of 25 January 2021
at the latest.

 

If appropriate, the information requested can be made available in
alternative formats, including other languages, Braille, large print, and
audiocassette. If you require any of these formats then please let me
know.

Please find attached the structure chart for Commissioning Team. The
Commissioning Team is currently in the process of reorganisation. The new
structure will be effective from 1 March 2021 and as yet no names have
been assigned to it.  If you were to reissue your request after 1 March we
would be in a better position to give you more accurate details of the
names of those officers whose roles are sufficiently senior to warrant
disclosure.

 

Also attached is the Procurement Team Structure chart.  The names of the
officers whose roles are sufficiently senior to warrant disclosure will be
disclosed to you this week, the other roles will remain blank as the
Council considers that this information is exempt from disclosure under
section 40(2) of the Freedom of Information Act 2000 (“FOIA”). However, we
wanted to provide you with the structures and the contact details now. 

 

This is the reason we would not be able to give you the names of
non-senior employees.  Section 40(2) provides that information shall not
be disclosed where it constitutes the personal data of someone other than
the applicant and that disclosure would satisfy one of the following three
conditions:

 

1.            That disclosure would breach any of the data protection
principles or would do so if the exemptions in section 24(1) (manual
unstructured data held by public authorities) of the Data Protection Act
2018 (DPA 2018) were disregarded;

2.                   That the disclosure of the information to a member of
the public otherwise than under the FOIA would contravene Article 21 of
the General Data Protection Regulation (GDPR) (general processing: right
to object to processing); or

3.            That on a request under Article 15(1) of the GDPR (general
processing: right of access by the data subject) for access to personal
data, the information would be withheld in reliance on provision made by
or under section 15, 16 or 26 of, or Schedule 2, 3 or 4 to, the DPA 2018,
or (b)on a request under section 45(1)(b) of the DPA 2018 (law enforcement
processing: right of access by the data subject), the information would be
withheld in reliance on subsection (4) of that section.

 

In this case, the relevant condition is the first condition. Specifically,
the council considers that the first data protection principle would be
breached; namely that disclosure would not be fair for the following
reasons:

 

1.    The information/ Part of the information constitutes sensitive
personal data and so represents information which should remain private;

2.    The reasonable expectations of the data subject(s) and the nature of
the information itself leads the Council to conclude that the data
subject(s) could not reasonably expect that this information would be
disclosed into the public domain;

3.    Neither this, nor similar information has been released into the
public domain by the data subject(s) or anyone else;

4.    That the principles of transparency and accountability under the
FOIA do not override the data subject('s/s') reasonable expectations that
this information would not be disclosed; and

5.    That the legitimate interests in the public having access to this
information do not outweigh the interests in preserving the rights and
freedoms of the data subject(s).

 

In reaching this decision, the Council noted that the following
consequences may occur if this information was disclosed:

 

1.    Release of this information may cause embarrassment to the data
subject(s);

2.    Disclosure may lead to the data subject(s) receiving unwanted and
unnecessary correspondence;

3.    Releasing this information may cause distress to the data
subject(s); and

4.    Disclosure of this information could cause the data subject(s) to
receive threats or to otherwise be intimidated.

 

In light of the above, the Council considers it necessary to withhold the
above-listed information.
