I am writing to request an internal review of Croydon Borough Council's handling of my FOI request 'Parking tickets issued'.

I do not believe you intend to publish the information I've requested

(1) I asked for the requests against the CEO number which does not form part of your TMA accounts
(2) You declined to publish the most recent accounts therefore I do not believe there is a realistic intention to publish anything.

Further to your email dated 17 January 2021, in which you requested an
Internal Review of the Council’s response to your request for information,
I have now concluded this review and I am able to reply as follows.

 

In your request for Internal Review, you asked the Council to reconsider
your request as you believed that you had not been provided with the
information requested.

 

In your request for information dated 11 December 2020, you requested the
following information:

 

“Please provide a copy of your parking enforcement policy

 

Please also provide a table showing the reference number of the
enforcement officer and the number of tickets issued in the month of
September 2020.”

 

The Council responded to you on the 6 January 2021 and provided you with a
copy of the Council’s Enforcement Policy. In respect of the request for a
table showing the reference number of the enforcement officer and the
number of tickets issued in the month of September 2020, this was refused.
As it was considered be exempt under Section 22 of the Freedom of
Information Act.2000 (FoIA) as it was information intended for future
publication.

 

In your request for an Internal Review dated 17 January 2021, you stated
the following:

On receiving your request for an Internal Review, I contacted Parking
Services, who have provided additional information in answer to the issues
raised in your Internal Review. The Council’s Traffic Management Accounts
are published on an annual basis and made available on the [1]Council’s
website on or around October of each year.

 

While there is an obvious public interest in how the Council carries out
its enforcement processes and the in particular the number of PCNs issued,
in this particular instance this need to be balanced against the
disruption to the audit process, to provide the specific information you
are seeking, which has not been audited and would need to be heavily
caveated. The Council considers that it is part of the effective conduct
of public affairs, to enable the publication of information to be carried
out in as a planned and managed activity. To enable all those interested
to have access at the same time. Releasing this information as requested,
could result in this partial and incomplete information leading to
confusion and inaccurate picture of parking enforcement and the issuing of
PCNs.

 

As has been stated previously the Council does have a regular process for
the publication of information in respect of PCNs as part of the
publication of the Traffic Management Accounts.

 

As a result the Council considers that this information is exempt under
Section 22 of FoIA as it is information intended for future publication.

 

Lastly in respect of the provision of the “…the reference number of the
enforcement officer and the number of tickets issued…”

 

I have been informed that the provision of that specific information may
result in the identities of the enforcement officers becoming known and
therefore that could be considered to be exempt from disclosure under
section 40(2) of FoIA in respect of personal information.

 

If you are not content with the outcome of the Internal Review, you have
the right to apply directly to the Information Commissioner for a
