I am writing in response to your request for information made under the Freedom of Information Act 2000.

You requested information as per your below e-mail.

However in line with the Freedom of Information Act 2000 the Trust needs to be clear of the authenticity of the request and therefore requires your name, as stated in Section 8 (Request for Information) of the Act.

For ease of reference Section 8 states the following:

Section 8 - Request for information:
(1) In this Act any reference to a “request for information” is a reference to such a request which—
(a) Is in writing,
(b) States the name of the applicant and an address for correspondence, and
(c) Describes the information requested.
(2) For the purposes of subsection (1)(a), a request is to be treated as made in writing where the text of the request—
(a) Is transmitted by electronic means,
(b) Is received in legible form, and
(c) Is capable of being used for subsequent reference

In addition the Information Commissioners Office Guidance (Valid Request – Name and Address for Correspondence), states:

ICO guidance (Valid request – name and address for correspondence) - What constitutes a real name? We consider that a relatively informal approach is also appropriate in this context. Therefore, title and / or first name with surname satisfies the requirement for provision of a real name, as does the use by a female applicant of her maiden name. The prime consideration is whether enough of a persons’ full name has been provided to give a reasonable indication of that person’s identity.

Therefore we would be grateful if you could provide us with your name at your earliest convenience.

We will place your request on hold and once we have received your clarification / confirmation we will be able to continue to process your request. If I do not receive clarification within 7 calendar days from the date of this correspondence your request shall be judged to have lapsed and will be closed.

The Act allows 20 working days for us to respond to your request so you can expect a response by 15th December 2020. Whilst the Trust will endeavour to answer your request within the permitted timescales, this may be delayed due to urgent operational responses dealing with current Public Health priorities. Hello FOI

I have viewed the public Eput website and have so far for example not found any information on the leads for the teams for and therefore unable to research their specialities and make an informed choice.
At present, it is unfortunately not possible to make an informed choice over the Team you are seen by at Eput. So Eput is no adhering to the Choice framework as set out by NHS England. For example, making choice easy and accessible to the patient and giving the patient the information they need to make choice based on facts. GP for example do not have the knowledge, no you condition well enough or the time to do research for you. Choice should be in the hands of the patient as much as possible rather than just guided by your local GP so they will just refer you to local Eput access and assessment.

I give below an example of an NHS trust providing a lot of information on their team leads and an example.

Compare this with your own website an example below for adult community health teams, there is no mention of the team leads just resource centres NO team leads specialities or sub specialities mental health.
Unfortunately, very little information for patients to make informed Choice.

I can provide you with NHS England information on how Choice should be provided to patients by providers if this would help?

Could you, therefore, please review your response in the light of this lack of information/clarity for patients to make their own informed choice decisions.

Amendments in relation to choice of health service provider

4.—(1) In regulation 39 of the 2012 Regulations (duty to ensure persons are offered a choice of health service provider)—

(a)for paragraph (2) substitute—

“(2) Subject to regulations 40 and 41, the choices specified for the purposes of this paragraph are the choice—

(a)in respect of a first outpatient appointment with a consultant or a member of a consultant’s team, of—

(i)any clinically appropriate health service provider with whom any relevant body has a commissioning contract for the service required as a result of the referral, and

(ii)any clinically appropriate team led by a named consultant who is employed or engaged by that health service provider; and

(b)in relation to an elective referral for mental health services in respect of which the patient’s first outpatient appointment is not with a consultant or a member of a consultant’s team, of—

(i)any clinically appropriate health service provider with whom any relevant body has a commissioning contract for the service required as a result of the referral, and

(ii)any clinically appropriate team led by a named health care professional who is employed or engaged by that health service provider.”;

The law is clear, patients need more information on Eputs consultants names and specialities so your patients can make an informed choice. There are examples of NHS trust providing this information clearly to patients and so far I have given just one example at slam.

Unfortunately I can not see it as of any use regarding patient choice regarding outpaients.
The document relates to a lot of admin structures and senior nursing roles not the clinical leads and their specialities.
I realised Eput has advised it is putting a list together to be avaliable on your website can you advise on anytime scales?
and is a partial list avaliable now?

Thank you for your e-mail correspondence below dated 17th February 2021. May I take this opportunity to confirm that we will treat this as a review of the original information sent to you in response to your request for information.

EPUT will carry out an internal review, investigating the issues / questions you have raised and provide a detailed response. The Information Commissioner considers that a reasonable time for completing an internal review is 20 working days from the date of the request for review. Therefore you can expect a response no later than 18th March 2021.

In some cases, which involve exceptional circumstances, it may be reasonable to take longer. If this is the case EPUT will contact you again and provide a full explanation as to why more time is required. However, the Information Commissioner considers that the total time taken should not exceed 40 working days.
