However, due to the current Coronavirus pandemic the Council is taking
steps to concentrate its resources on helping those who are most
vulnerable or at risk. This has meant taking our staff away from their
usual work to other areas of priority and need.

seriously, however; the reality of the current situation means that we may
not be able to respond to your request within the statutory time frame.

Thank you for your request for information under the Freedom of
Information Act 2000, received 21 September 2020. Your request has been
considered and our response is in bold below.

 

You requested the following:

The Council’s Response

Please find attached the current structure charts for the Services
requested.

 

We would also like to inform you that a structure chart showing the top
two tiers of the Council is available on the Council's website and is

Section 21 of the Freedom of Information Act.  Section 21 (2a) states that
information which is reasonably accessible to the applicant is exempt. 

The London Borough of Hackney does not publish the names of contact
details of staff below Tier 3 in its organisational structure. This is
because they are entitled to consider themselves private individuals. In
this case we have applied Section 40.

 

Section 40 (2) of the Freedom of Information Act requires public
authorities to consider whether disclosing the information would
contravene the GDPR data protection principles.

The Council has to consider whether it would be ‘Fair and Lawful’ as per
the 1st Data Protection Principle to publish the names of staff who are
not senior management.  The Council also has to consider what impact
disclosure of direct contact details, as well as names of staff who are
not senior management, would have on those members of staff.  As a Freedom
of Information request is a disclosure to the public at large, the Council
is not satisfied that disclosure of direct contact details or names of
staff other than senior staff would be fair. 

 

Please also note that Hackney Council is in the process of  restructuring
the Services of how the Council works  and it is most likely that the
charts provided will be changed in the future.  In this case, the
information is exempt by virtue of Section 22(a) of the Freedom of
Information Act. 

Section 22 (1a) states that information is exempt if the information is
held by the public authority with a view to its publication, by the
authority or any other person, at some future date (whether determined or
not).

 

Appeals & Complaints Procedure

If you are dissatisfied with this response and wish to appeal, please
reply to this email and this will be dealt with through our Internal
Review procedure.

 

Your request should be submitted to us within 40 working days of
receipt of this response. Any request received after this time will only
be considered at the discretion of the Council.
