The NIAO published an informative report on injury pensions in March 2020:

https://www.niauditoffice.gov.uk/sites/n...

One backdated payment cost £429,000 in arrears alone.

Appendix 4 includes examples of the amounts payable to officers dependent on years of service and the extent of disablement.

BBC story:

'The Police Service of Northern Ireland (PSNI) is facing a bill of nearly £500m for officers hurt on duty.
The Audit Office has called the scheme for payments "not fit for purpose", and said substantial changes were needed to make things affordable.'

Dear Information Compliance,

Clarification:

"8. Please provide the number of officers in receipt of an injury award (include those who were awarded injury benefit by another force) who currently work for your force, if any."

The word "officers" refers to former officers granted injury awards, not officers currently working for you who were previously granted injury awards. In other words, I am interested in former officers granted injury awards who currently serve in any role e.g. staff.

Yours sincerely,

D. Moore

Dear Humberside Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Humberside Police's handling of my FOI request 'Reviews of injury benefits'.

There is a problem with the document you sent me, but I have just realised that I can view it.

I wish you to review your response to my first and third requests:

'1. How many individuals currently receive injury awards from your force?'

You responded:

'IOD awards are only awarded to police officers who have left the organisation on Ill health retirement, so none currently employed by the force'

My request could have been clearer. A minority of police forces did not respond to this request as I wished.

What I want is the total number of former officers who currently receive injury awards from your force

Regarding my third request:

'3. For each of the three years 2017/18, 2018/19 and 2019/2020 please provide the amount paid to all those in receipt of injury awards.'

You failed to provide information for the years 2018/19 and 2019/20.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/r...

Yours faithfully,

D. Moore

Injury pension case (May 2021):

'24. The claimant exercised his right of appeal to a BMR provided for by regulation 31 of the 2006 regulations. The BMR in this case was the defendant, PMAB.

43. The Report then goes on to set out that the PMAB found that it had insufficient information to carry out its function and elected to request that it be provided with complete clinical records (occupational and GP) before providing an outcome.

Ground 2 : The PMAB’s position that it did not have access to the Claimant’s medical records was perverse.

62. (3) Accordingly, on ground 2, I would grant permission but direct that within 7 days of the handing down of my judgment any application to amend the grounds is issued and served. That application should be listed to be heard at the substantive hearing.'

Important information regarding the backdating of injury awards can be found in this appeal by the Chief Constable of South Yorkshire Police:

[2021] EWCA CIV 1699

https://www.bailii.org/ew/cases/EWCA/Civ...

The appeal was dismissed.

The former officer was permanently disabled in 2005 and required to retire. He claimed an injury award in 2016.

"43. It follows, in my judgment, that at any given time a former police officer is either entitled to an injury award under regulation 11 or he is not, regardless of whether he has made a claim..."

The award was backdated to 2005.
