Thank you for your email below asking us to conduct a further review of your request for information relating to Burntisland Fabrications Limited.

As you will be aware, we have already undertaken a review of our initial response and therefore as we advised, if you remain unhappy with the outcome of our review you have the right to appeal to the Scottish Information Commissioner about our decision within 6 months of that decision which was dated 7 September 2020.

You may find it helpful to note that under FOISA we consider whether information is exempt from disclosure based on the circumstances of the case at the date the initial request was received. Therefore any appeal will consider whether we were entitled to withhold the information you requested based on the circumstances on 8 July 2020.

If you consider that the passage of time and any change in circumstance since you made your initial request would have an material impact on whether the information you have requested is exempt from disclosure, you may wish to make a fresh request to the Scottish Government. This would be considered in the current circumstances as of the date you submit your new request. You can do so by sending your request for information to [Scottish Government request email] or by responding to this email.

Yes the circumstances have changed in a major way since I made the FOI request last year. The company has gone bankrupt and the yards sold off to a new company called Infrastrata. It is explained in this letter from the government ministers.
