• We will aim to have a least one BEIS official on hand for the debate and wil provide the name or
names early next week;
• Thanks for the confirmation of an early view of the briefing and speech. We have pul ed
together some lines to take and background briefing which we intend to send across to you later
today or (more likely) tomorrow to cover the planning issues. We are also going to offer some
briefing on the solar energy sector – but have to rely on BEIS colleagues for that so please bear
with us;
• EN-3 is relevant in that it sets out the general need for renewable energy. What it doesn`t set
out is the framework against which to consider impacts arising from solar projects and the
weight that should be accorded to them in the planning balance. So, in considering these
issues, the Secretary of State would need to step outside of EN-3 to make any judgements on
planning merits.

planning side of the text – including doing some re-arranging to try to give a bit more of a

his thoughts on that one.) As before, I hope that these changes work (and that the formatting
hasn`t been compromised).

I haven’t covered off anything on compensatory measures to mitigate environmental issues which
the Minister was interested in. From a look at the application documents submitted for Cleve Hill,
the developer is proposing mitigation on a number of environmental fronts but this will be subject to
consideration by the Examining Authority and the BEIS SoS.

not own it – as it is applying for the compulsory acquisition of the land it needs. (Though it is trying

Further to your e-mails below and earlier today, please find attached revised texts of the speech and
briefing for the Adjournment Debate. On the former, your e-mail from early this afternoon made a
couple of suggestions for changes to the texts in paragraphs 9 and 10 of the speech that had been
cleared by your legal team:
9. “I can assure honourable members that the NSIP planning process is open and robust and

infrastructure developments. Projects subject to the European Environmental Impact
Assessment Directive, such as the Cleve Hil scheme, must be assessed to consider their

We do not think that these amendments work because: (on paragraph 9) it seems strange to refer to
European legislation as the basis for a consideration of impacts at this particular point in time. I
think that if a legal basis is necessary, then we should refer to the EIA Regulations which apply to
development consent applications; and (on paragraph 10), the Secretary of State is the competent
authority for Habitats purposes not the Planning Inspectorate. I have made some changes to
paragraph 9 to reflect the above point as well as revising the thrust of the preceding paragraphs (on
propriety).
More general y, on the speech, we do wonder whether the references in paragraph 28 to initiatives
outside the UK are taking things a bit too far away from the more local environmental issues which
wil be of more interest to the MP and her constituents.
On the briefing, I have done a bit of tidying up of some of the sections that we provided (so
apologies for not getting this sorted out first time around). I have also added caveats to the two
sections on NE and EA thinking about the Cleve Hil proposal and on the EA’s position on managed
retreat. Hope those changes work for you.

I also attach some miscellaneous (perhaps esoteric) briefing covering a range of possible
intervention topics. I think we wil need to see how the meeting on Thursday goes before deciding
whether it should be included in any final briefing that goes to the Minister. I may also pick up
some briefing on intermittency of certain renewables generation to cover off any attacks on that
side of things and will aim to feed this in as soon as I can.

Please note I have accepted the vast majority of the edits you proposed, with a small number of
exceptions. For example, I have left some of the nature recovery network wording in the briefing as
this is a particular issue flagged by Helen Whately MP, but I have edited it to avoid relating it directly
to the application site.
We have been careful to ensure the advice on handling for the debate and the signposting of the
proprietary guidance remains prominent.
Following internal circulation we have also made a series of amendments, mostly minor, to both
documents. The biggest change to the speech is additional content on Defra work addressing climate
change as well as the natural environment.

I have to say that we are still puzzled as to why your Minister is leading on what, according to the
title of the Adjournment Debate, is very much a planning issue. The application for development
consent for the Cleve Hill project is currently with the Planning Inspectorate for examination and in
due course, the Inspectorate wil send a report on its conclusions to SoS BEIS for a decision. Given
that position, any light you can shed on why Defra seems to be in the lead on this matter – for
example, if Helen Whately has changed the focus of the debate from that in its title – would be
gratefully received.
