Thank you for your email received on 19th May 2020 with regards to the council’s Freedom of
information response to you.
Your request was received by the council on 15th May 2020 and a response was sent to you on
18th May 2020. This was within the legislative time frame.
Your Complaint
In your original request you asked for details of compensation claims filed against the council for
all Asset of Community Value (Community Right to Bid) nominations the council has received
since 2012. Relating to each claim you asked for
The result of the compensation claim
A copy of all documents submitted with the claim by the owner
A copy of any additional documents the council considered in deciding the claim
A copy of the council's decision letter to the property owner
If the owner requested an internal review of the compensation claim - A copy of all
associated documents
If the owner requested an independent review to the first tier tribunal - A copy of all
associated documents
The council refused this request by applying a Section 40 (2) personal data, exemption. You
have complained that you have requested the information from other local authorities and that
they have provided you with the data you have requested. Although I appreciate this, I cannot
comment on what data any other authority may or may not consider fit for disclosure. The
documents requested above would clearly identify the persons involved in any claims, and even
with redactions, this could still be the case.

language, please telephone 020 7527 2000.
The council is obliged to advise and assist under Section 16 of the FOIA, and I have since been
back to the service that would hold this information to enquire the number of claims so I could
provide this to you. However, this number is so low that I feel disclosing this could potentially
identify those involved.
Conclusion
I do not up-hold your complaint. I appreciate that the data you have requested may have been
provided to you by other local authorities, however, as advised above, I believe the disclosure of
these documents, in any form, would lead to the potential identification of those involved.
Based on this I am satisfied that the exemption has been applied correctly and your request was
handled within FOIA legislation.
Should you remain dissatisfied with this response, you are entitled to escalate the matter to the
Information Commissioner's Office,
