Freedom of Information – Request for Information

Thank you for your request for information dated 6 May 2020, and further to my email sent to you
on the 19 June 2018, apologising for the delay in responding to your request.
Firstly please accept my apology for the lateness of my reply; this was due to an oversight on my
behalf, which I can only explain to the pressure of work undertaking other duties to support the
impact of COVID-19. You have requested the following information:
From 1st January 2020 to the day this request is processed, I would like to request all
correspondence and communications between this authority and the Care Quality
Commission that mentions, or refers to, the coronavirus.
I am happy for you to conduct an electronic search only. Please conduct a search among
the department(s) that is most likely to have interactions with the Care Quality Commission.
I am pleased to advise that the Council can provide the information that you have requested.
All correspondence, which are all in the form of e-mails between the Council and CQC, that our
search has located is attached to this letter. In addition to the e-mails the Council has copied the
CQC into it’s daily briefings to the provider market, the copies attached are the versions sent out
on Friday each week as these include all daily briefings for that particular week.
*Please note under s40(2) of FOIA, some of the information has been redacted on the attached
documents as it contains third party personal data of which the applicant is not the data subject.
This exemption applies because you have made a request for information that comprises or
contains personal data information about a third party. The Council has determined that the
information relating to the third party should not be disclosed because disclosure would contravene
one or more of the ‘7 key principles’ that are set out under Article 5 of the General Data Protection
Regulation (GDPR) which includes the principle that information should be ‘processed lawfully,
fairly and in a transparent manner in relation to individuals.’ The term ‘personal data’ means data
that relates to a living individual who can be identified.
In accordance with section 17 of the Freedom of Information Act 2000 this letter acts as a Refusal
Notice in respect of this part of your request

If you are unhappy with the service you have received in relation to your request and wish to make
a complaint or request a review of the Council's decision, you may do so within 40 working days of

If you are not content with the outcome of your complaint, you may apply directly to the Information
Commissioner for a decision. The Commissioner cannot normally make a decision unless you
