Dear University Hospitals Birmingham NHS Foundation Trust,
1. Please could you provide details of the legal costs incurred, or an estimate of
the costs expected to be invoiced to the Trust but not yet incurred, by the
Trust:
a) in connection with the Employment Tribunal proceedings re Mr Tristan
Reuser, £33,032.50
b) in connection with the Employment Appeal Tribunal proceedings re Mr
Tristan Reuser. £26,179.79
2. Could you please indicate which person, or which group of people, committee,
or sub-committee of the board approved the expenditure.
In accordance with the Trust’s Scheme of Delegation external legal fees are
authorised by the Chief Legal Officer (formerly Director of Corporate Affairs) and/or
his Deputy.
3. Given that the CEO was involved in the proceedings, please indicate what
steps were taken to ensure that any potential conflicts of interest were
managed.
As a witness Dr Rosser was kept apprised of the progress of the proceedings but
decisions as to its management were taken by members of the Corporate Affairs
team, consulting with the Chair of the Trust, where appropriate.
4. Please indicate where and when reports of the progress of these proceedings
were reported to the board, and please provide copies of the minutes of any
meetings where reports were presented (redacting, where necessary, any
information that remains confidential at the time that this request is
processed).
