Request under the Freedom of Information Act 2000 (the Act) 
 
The council has considered your request which was received on 6 April 2020 and our 
response to your questions is shown below. 
 
Under the Freedom of Information Act 2000, I would like to request data 
regarding the number of motorists issued PCNs for wrongly parking in 
designated disabled person’s parking bays. 
 
Can I please receive a total count of PCNs issued for violating the following 
contravention codes: 
Code 40. ‘Parked in a designated disabled person’s parking place without 
displaying a valid disabled person’s badge in the prescribed manner.’ 
Code 87. ‘Parked in a designated disabled person’s parking place without 
displaying a valid disabled person’s badge in the prescribed manner.’ 
 
I wish to solely receive the total amount of PCNs motorists have been issued 
for violating these codes. 
 
If I could please receive this total count for the time period of 01/04/2018 - 
31/03/2019 that would be fantastic. 

 
The council has determined that this information is exempt from disclosure in 
accordance with section 21(1) of the Act as it is reasonably accessible to you by other 
means and publically available. The council publishes data related to PCNs on the 
council’s Open Data webpage, accessible via the below link. Please be advised that 
this information is recorded by calendar year, not financial:

The spreadsheets on the right hand side of the page give details of all PCNs issued 
by the council since 2008. You can open the files for 2018 and 2019 and filter the 
column titled ‘issue_date’ to find PCNs issued within the period you have outlined. 
 

 
You can then filtee the contravention column to show only the following 
 
contraventions: 
 
 
•  Parked in a designated disabled persons parking place without displaying a 
 
valid disabled persons badge in the prescribed manner 
 
•  Parked in a designated Disabled Persons parking place without clearly 
displaying a valid disabled persons badge 
 
•  Parked in a disabled person’s parking space without clearly displaying a valid 
disabled person’s badge 
 
The council has relied on sections 16 and 21 of the Act as it is providing you with 
advice and assistance by directing you to our website where you can find some of the 
information you require. Please accept this letter as a partial refusal notice issued in 
accordance with section 17 of the Act. 
 
You are free to use any information supplied for your own personal use. If the 
information provided is marked as published under an Open Government Licence you 
are free to reuse it, subject to the licence terms. However, if the information is not 
published under an Open Government Licence and you wish to reuse it, for example, 
by publishing the information or issuing copies to the public you are required to 
request permission for re-use of this information under the Re-use of Public Sector 
Information Regulations 2005 (RPSI). Your RPSI request must be in writing and 
include your name and address for correspondence, and specify the information you 
want to re-use and the purpose you intend to use it for.
