This policy applies to al employees who are engaged on a University of Derby
contract of employment.
The University of Derby believes the professional relationship between a student and
a member of staff is an important part of the student’s educational development. It is
vital that trust and confidence exist between staff and students to ensure that
students maximise their learning experience.
The University discourages consensual relationships between staff and students
(irrespective of the students age) in the learning environment and in al areas of
support, guidance and administration, and regards it as unprofessional for a member
of staff to actively seek to initiate such a relationship,
or to pursue such a
relationship without regard to the full range of issues or problems that may ensue.
It is the University view that any sexual relationship with a student under the age of
18 years and those over the age of 18 who are regarded as adults with care and
support needs wil be considered gross misconduct by that member of staff and the
University wil consequently invoke the disciplinary procedure.
The University also recognises that there are a few areas within the organisation
where specific local requirements or a code of professional standards of conduct,
practice and ethics may mean that any relationship with a student regardless of age
wil have to be declared. In these areas Line Managers are required to ensure that
staff are aware of the relevant local requirements and professional standards. Those
employees with professional body registrations also have an individual responsibility
to be familiar with and meet the expected standards of conduct required of them by
their professional body in maintaining registration. Failure to follow these local and
professional guidelines may lead to disciplinary action and may be considered gross
Where staff are involved in a personal relationship with another member of staff the
safeguards contained within the Personal Relationships Procedure should be
followed in order to protect both parties involved.
