DISCIPLINARY POLICY STATEMENT
This policy applies to all employees (with the exception of University Executive for
whom alternative arrangements are in place) who are engaged on a University of
Derby contract of employment. The roles and responsibilities for this policy are set
out in the general document which applies to each policy.
The purpose of the Disciplinary Policy and Procedure is to ensure that the highest
standards in relation to conduct, behaviour, performance and attendance are met, in
order to meet organisational objectives. In the event of an employee failing to meet
or maintain these standards, including in relation to capability, the matter wil be
handled in a fair and consistent manner.
The disciplinary procedure is designed to support and encourage employees to
achieve and maintain high standards; it wil normal y only be used when other
interventions have failed to produce the required improvement or when the matter is
sufficiently serious to require immediate formal action.
The University reserves the right to instigate the process at any stage, as set out
in the procedure document, taking into account the alleged matter in hand.
This policy and procedure are agreed with recognised trade unions and comply with
relevant legislation and the ACAS Code of Practice on disciplinary procedures.
Audio/video recordings (covert or otherwise), are not permit ed in any disciplinary
meeting, investigation or hearing (informal and formal). There may be occasions, for
example, in complex cases or to accommodate certain disabilities, where
adjustments may be made to this practice.
At any stage of the disciplinary proceedings care must be taken to ensure that
employees are not unlawfully discriminated against or unfairly disadvantaged in any
way and that full account of any protected characteristic has been taken.
