Dear Torbay Borough Council,

Upon speaking with someone I know, I have become aware of Torbay Council's abuse of the vulnerable.

Please answer the following:

1. Why do you place vulnerable adults with severe mental health problems in unsuitable temporary accommodation?

2. What temporary accommodation would you deem suitable for someone with complex and severe mental health issues?

3. Why do you place a vulnerable adult with complex and severe mental health problems in unsuitable accommodation with a convicted pedophile by the name of Garry Loftus?

4. What time frame do you have, for investigating complaints and why do you ignore SERIOUS complaints?

Dear Torbay Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Torbay Borough Council's handling of my FOI request 'Vulnerable People'.

You claim that my request relates to procedures and not recorded information. Well your procedures will be recorded, in a effort to train staff in policy and procedure.

Again in relation to ignoring complaints, you will have a policy as to what will and wont be investigated or recorded. This may be in the form of written or verbal.

Again, you have placed a vulnerable adult in unsuitable accommodation with a convicted pedophile named Garry Loftus. I found that rather amusing that you removed the name, when I already know the name, as do the public, whom have a right to know. You were aware of this fact when placing a vulnerable adult in unsuitable accommodation.

Case 398629

Further to your complaint received on 19 August 2019 I have been asked to
undertake a review of the response to your request for information under
the Freedom of Information Act 2000 request 19200687.

Your request asked specific questions in respect of the Councils placement
of vulnerable adults and those with complex and severe mental health
issues.

You were advised that as your requests were not requests for recorded
information, they did not fall to be responded to under Freedom of
Information legislation, and that some of the information that you
requested was freely available on the Councils website. You were unhappy
with this response and you have requested an internal review as you are
entitled to do.

I have considered your request and the information available.

In respect of questions 1 – 3 of your request I must agree that these are
not Freedom of Information requests.

The access to information regime is for members of the public to obtain
recorded information held by the Council and not information that it is in
someone’s head, for descriptions, explanations, or justifications. Neither
are the Council required to create a document for the purposes of
fulfilling a request.

You have in your email of 19 August 2019, referred to Councils policies in
so far as they lay down procedures. Your initial request did not ask for
Council policies. Nevertheless you were provided with advice and
assistance as to where to find housing policies by way of an internet
link.

Additionally, in respect of question 4 of your request you were given a
link to the Councils Complaints Procedure, which is to be found online.
When information is already reasonably accessible to an applicant the
Council is entitled to rely on section 21 of the Freedom of Information
Act and refuse a request.

The Public Interest Test

I am not required to consider the public interest test on this occasion as
no qualifying exemptions have been applied to your request.

Conclusion

I am satisfied that the response to your request was correct and that
sufficient advice and assistance was given to you. I am therefore unable
to uphold your complaint.

If you remain unhappy with the outcome of your internal review, you are
entitled to refer your complaint to the Information Commissioner's Office
(ICO) for a decision.
