Freedom of Information Act (FOIA) Request – 191015017
Thank you for your request, received on the 15th October 2019, for an Internal Review of
FOI 190916006. We have interpreted your request as a review of the following information
from the Ministry of Justice (MoJ):
1) Can you also confirm whether the Official Receiver attached to the county
court hearing centre at Maidstone has received any confirmations from the
county court of a pending action in bankruptcy filed by Maidstone Borough
Council in 2018/2019 as a creditor on a bankruptcy petition, please provide the
PAB dates and the name of the Insolvency Office and date they were received.
2) Are your Official Receivers aware of these practices who have access as a
court officer to the bankruptcy cases, how many have they received prior to
and including 2018/2019?
The purpose of an Internal Review is to assess how your FOI request was handled in the
first instance and to determine whether the original decision given to you was correct. This is
an independent review: I was not involved in the original decision.
The response to your original request confirmed the information requested is not held and
should instead have been requested from The Insolvency Service. After careful
consideration I have concluded that this response was compliant with the requirements of
the FOIA.
Statutory deadline
The statutory deadline for your request was the 14th October 2019 and the response was
provided to you on the 14th October 2019 within timescale. The response was therefore
compliant with the requirements of the FOIA.
Outcome
In conclusion, I can confirm that searches for this information where carried out where
possible but the Ministry of Justice does not hold any information in the scope of your
request. This is because we are not the appropriate authority to contact on this subject (as
we are unable to say what the Official Receiver holds).
In our response to you on 14th October 2019 we advised that you may wish to contact the
Insolvency Service as they may hold some of the information you requested.
