Freedom of Information Act (FOIA) Request – 190621005
Thank you for your request dated 21 June 2019 in which you asked for the following
information from the Ministry of Justice (MoJ):
Dear Ministry of Justice, can you inform me of the number of prisoners at Sudbury
and Ford prisons who have access to cars for transport to work outside the jail and
the crime they were convicted of. Please inform where the vehicles are parked and if
any checks are made to see if they are insured and roadworthy.
Your request has been handled under the FOIA.
I can confirm that the MoJ holds all of the information that you have requested. However,
some of it is exempt from disclosure under section 40(2) of the FOIA, because it contains
personal data. . I can confirm that there are 67 people at HMP Ford and 76 people at HMP
Sudbury on paid work that would be eligible for their own vehicle.
The release of the details of individuals’ convictions cannot be released, as to do so would
risk the identification of those individuals.
Personal data can only be released if to do so would not contravene any of the data
protection principles set out in Article 5(1) of the General Data Protection Regulation and
section 34(1) of the Data Protection Act 2018.
We believe releasing the requested information into the public domain would be unlawful.
Individuals have a clear and strong expectation that their personal data will be held in
confidence and not disclosed to the public under the FOIA.
This is an absolute exemption and does not require a public interest test.
HMP Ford and HMP Sudbury have dedicated staff with the responsibility of managing the
transport side and if someone applies to have use a vehicle, all relevant documentation is
required such as the log book, MOT and insurance certificates, as well as their valid driving
licence prior to the vehicle being approved and allowed on site. Applicants also are required
to pass an enhanced security check. All vehicles are subject to random and intelligence led
searches

You do have the right to ask the Information Commissioner’s Office (ICO) to investigate any
aspect of your complaint. However, please note that the ICO is likely to expect internal
