I would like to know how many arrests have been made between 01/01/2018 and 01/01/2019 under section 5 of the Public Order Act.
I would like to know how many of these arrests if any were made for swearing at a police officer in public.
Finally I would like to know how many people were charged and prosecuted in relation to swearing at Police under Section 5 of the Public Order Act.

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

 

Thank you for your e mail dated 2 April 2019 in which you made a request
for access to certain information which may be held by Northumbria Police.

 

As you may be aware the purpose of the Act is to allow a general right of
access to information held at the time of a request, by a Public Authority
(including the Police), subject to certain limitations and exemptions.

 

You asked:

1.     I would like to know how many arrests have been made between
01/01/2018 and 01/01/2019 under section 5 of the Public Order Act.

2.     I would like to know how many of these arrests if any were made for
swearing at a police officer in public.

3.     Finally I would like to know how many people were charged and
prosecuted in relation to swearing at Police under Section 5 of the Public
Order Act.

 

 

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

 

Following receipt of your request, searches were conducted within
Northumbria Police. I can confirm that the information you have requested
is held in part  by Northumbria Police.

 

I am able to disclose the located information to you as follows.

 

The data has been taken from the central database using the arrest table
where the HO code for the arrest was in the following offences:

 

125/12 9A Public fear, alarm or distress Other Offences Harassment, alarm
or distress.

125/58 9B Racially or religiously aggravated public fear, alarm or
distress Other Offences Racially aggravated harassment, alarm or distress.

125/61 9B Racially or religiously aggravated public fear, alarm or
distress Other Offences Religiously aggravated harassment, alarm or
distress.

125/63 9B Racially or religiously aggravated public fear, alarm or
distress Other Offences Racially or religiously aggravated harassment,
alarm or distress

 

Each arrest record was reviewed and where the MO included the following:
Police being sworn at, continuing to swear in the presence of the police
following a warning, abusive and aggressive, threatening and abusive and
verbally abusive, they were included.

 

The results of those searches is as below.
