Thank you for your request for information dated 19/02/2019 concerning Dog
Harassment Incidents.

 

Dyfed-Powys Police acknowledge receipt of your request which is being
processed under the Freedom of Information Act 2000 however, prior to
processing the request please would you clarify

 

i)              When you ask for prosecutions, do you mean “found guilty
at court”?

ii)             Please clarify what is meant by past three years.  Are you
referring to calendar years i.e. 2016, 2017 & 2018 or financial years?

 

After receiving the clarification, your request will then be considered and you
will receive a response within the statutory timescale of 20 working days as
defined by the Freedom of Information Act 2000, subject to the information not
being exempt or containing a reference to a third party. If we do not receive
clarification from you within 40 working days, then your request will be closed.

 

There may be a fee payable for the retrieval, collation and provision of the
information you request. If this is the case you will be informed and the 20
working day timescale will be suspended until we receive payment from you. If
you chose not to make a payment then your request will remain unanswered.

Dear FOI,

Thank you.

I’ve receved a helpful reply from another police e authority.

There are four offences that fall under the PHA 1997 and they are listed
below. The way of finding the information that we would use would be to
keyword search all offences.

Would you like crimes where the dog is owned
by the victim or perpetrator, or both?

Offence Title
Protection from Harassment (S2 PHA 1997)
Putting people in fear of violence (S4 PHA 1997)
Purse course of conduct - Stalking (S2A PHA 1997)
Stalking (S4A 1 (b)PHA 1997 - either involving fear of violence or
Stalking involving serious alarm/ distress )

Response= Both

If the response could be broken down into

1. reported incidents and
2. Successful prosecutions in the categories above

I would be grateful.

And the date is from the date of request ( since we are nearly at the end of the financial year)

But if the years are obtainable, please could you send me them too.

The reason is that I am trying to find out:

If incidents in which dogs are involved are increasing.

- I have asked other police authorities for their stats, so hopefully responses wil provide an accurate picture.

It is with regret that I have to inform you that the 20 working day deadline (19/03/2019) under section 10 of The Freedom of Information Act in respect of this request has not been met, due to difficulties in retrieving and collating the relevant requested information or delays in the FOI process.

I write in respect to your request for information dated and received
within the Freedom of Information Unit on the 19^th February 2019
regarding dog related harassment.

Please can you advise whether or not you still require an internal review?
Should you not indicate whether you still require the review within 5
working days the matter will be closed and the internal review process
will not be conducted.

 

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

 

Dyfed-Powys Police are unable to confirm or deny whether it does hold the
information you have requested, since we consider that the Section 12(2)
exemption the Cost of Compliance exceeds the Appropriate Limit applies to
it.

 

Where exemptions are relied upon Section 17 of the Freedom of Information
Act 2000 requires Dyfed-Powys Police, when refusing to provide such
information (because the information is exempt) to provide you the
applicant with a notice which:

(a) states that fact,

(b) specifies the exemption in question and

(c) states (if that would not otherwise be apparent) why the exemption
applies.

 

Please see the attached response document which indicates the time
estimated by the Force it would take to complete the request as a whole.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for the whole of this request under Section 17(5) A
public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with section 1(1), give the applicant a notice stating
that fact. You may wish to refine and resubmit your request so that it
reduces the time shown above to fall within the 18 hours, however with due
regard to the time estimate provided above it is unlikely that refining
your request will fall under the 18 hours as the same method and format
will have to be undertaken. Should you require any further advice in
relation to this matter please don’t hesitate to contact the Freedom of
Information Unit.

 

Please also be advised that should the request be refined, it does not
remove the public authorities right to cite exemptions if relevant.

RE:  Request for Internal Review – Dog related harassment

 

I refer to your request for Dyfed Powys Police to review its previous
response to your request for information.

 

I have considered the case, including all correspondences and your
explanations as to why you seek a review; whilst I understand this shall
be disappointing to you, I confirm I uphold the original response
provided.

 

In considering this matter I have considered clarifications provided by
the heads of department responsible for collation of such data; I am
advised that;

(i)             there is no automatic functionality or keyword search
function which would assist to collate a relevant dataset;

(ii)            System tags/ flags for dog related incidents are only
applied in connection with dangerous dogs (eg prohibited types);

(iii)           DPP do not sub-classify the recording of crimes,
therefore;

(iv)           staff would need to make enquiry of at least two relevant
Force systems, assess and extract relevant data for enquiry and collation;

(v)            Test searches confirm the time estimates provided are
appropriate averages.

 

Accordingly, I am satisfied that the Freedom of Information Act 2000 has
been complied with in considering your request for information and that an
appropriate response has been provided to you as relevant to the Force
information concerned with an explanation of the exemption applied.

But please could you address the points that I asked you to review.

> Could you please state if your recording system differs from that of other police forces and, if so, the what your system of filing complaints is ? (the name of it)

Could you explain EXACTLY what work needs to be done... on the systems ( you say there are two)

Presumably they are the same for all police forces.

Here is a Handy checklist, from the Met.

Not exactly known for its country pursuits...

Animal crime
Wildlife and animal crime can be a complex area to understand.

To find out what wildlife crime is, go here.

Crimes involving animals that aren’t wildlife crimes, include:

livestock worrying
livestock theft
hunting
animal cruelty
dogs being out of control in public places
banned dogs
Livestock worrying

Livestock worrying is a criminal offence and comes under the Dogs (Protection of Livestock) Act 1953.

‘Worrying’ is where a dog attacks or chases livestock causing injury or suffering.

This isn’t just a threat to a farmer or land owner’s livelihood, it’s also a dangerous situation for the animals involved, and could lead to more risk if the animals get onto the road.

A farmer is allowed to kill the dog if it’s worrying their livestock.

Always keep your dog under control around other animals and if you see a dog on the loose worrying animals, call 101.

Livestock theft

Grazing animals can be an easy target especially in remote rural locations.

check on your animal(s) regularly
report any suspicious vehicles
improve security around the area where the animal(s) graze
ear tags, horn brands, freeze marking, hoof branding, tattoos and microchips can all help identify your animal(s) if they’re stolen
in the case of cattle (cattle, bison or buffalo) you will need to report the loss or theft of an animal to the British Cattle Movement Service within seven days
some areas have Farm Watch schemes, which might be worth joining

Remember, a horse passport is a legal requirement. You can find out how to apply for one here.

Report livestock theft to us either online or by calling 101.

Hunting

Fox hunting

Fox hunting is illegal; trail and drag hunting (where the hunt follows an artificial scent laid out in a trail) is legal. Dogs can be used legally as part of a trail or drag hunt.

There are exemptions under the Hunting Act 2004 which allow for wild animals (including foxes) to be ‘humanely’ killed. Dogs can be legally used to ‘flush’ a fox from cover so it can be shot.

It is an offence to:

engage or participate in the pursuit of a wild animal
use or allow a dog or dogs to pursue a wild animal
knowingly allow land to be entered for the purpose of hunting a fox
hunt foxes with dogs

If you think someone has broken the ban on fox hunting then that's a wildlife crime and you need to let us know, either online or by calling 101.

Animal cruelty

Animal cruelty is when someone doesn’t care for or deliberately hurts an animal.

It can include anything from physical violence, to deliberate mental distress or neglect, for example not feeding or cleaning an animal.

If you see, or suspect, that a person may be treating an animal badly, whether this is physical violence, neglect or any other form of cruelty, you should report this to the RSPCA’s 24-hour cruelty line.

You can contact them on 0300 1234 999. The call will cost the same as any call to a UK landline number.

We work with the RSPCA to investigate cases of animal cruelty.

Dogs out of control in public places

It’s an offence to let a dog be dangerously out of control whether that’s in public or private.

A dog is considered to be out of control if it:

injures someone
makes someone worried that it might injure them

A court could also decide that your dog is dangerously out of control if:

it attacks someone’s animal
the owner of an animal thinks they could be injured if they tried to stop your dog attacking their animal

Please note, a farmer is allowed to kill your dog if it’s worrying their livestock.

If you see a dog loose or seemingly out of control, please tell us by calling 101.

Banned dogs

In the UK, it’s against the law to own certain types of dog. These are the:

Pit Bull Terrier
Japanese Tosa
Dogo Argentino
Fila Brasileiro

It’s also against the law to:

sell a banned dog
abandon a banned dog
give away a banned dog
breed from a banned dog

Whether your dog is a banned type depends on what it looks like, rather than its breed or name.
