With reference to your e-mail received 17/09/2018 requesting information relating to third party personal data:

Northamptonshire Police can neither confirm nor deny that it holds information relative to your request as the duty in Section 1(1)(a) of the Freedom of Information Act 2000 does not apply by virtue of the following exemptions:

Section 40(2) – Third Party Personal information

The information you request is exempt under Section 40 (2) of the Freedom of Information Act 2000. This absolute exemption applies because the right given under the Freedom of Information Act 2000 to request official information held by public authorities, does not apply to personal data or personal data of third parties. Any requests for third party information become subject to exemption in consideration of infringement of the Principles of the Data Protection Act and therefore attract pursuance of exemption under section 40(2) of the Freedom of Information Act 2000 - in this instance disclosure would breach Principles A, B and F of the Data Protection Act 2018.

By way of further explanation the information which you seek, because of the type of information you are requesting relates to a person who could be identified in releasing their call. As such, the exemption under Section 40(2) of the Freedom of Information Act 2000 is applicable. This is an absolute exemption from disclosure of information relevant to your request under the Freedom of Information Act 2000

I will also remind you this is the second time you have made a request for third party personal data incorrectly under this act. Any further requests of this nature are likely to be considered for Section 14 vexatious.

I trust you find this information to be satisfactory but if you have any further queries please do not hesitate to contact me.

Northamptonshire Police provides a review and appeals procedure within the terms of the Freedom of Information Act 2000. If you decide to make an appeal and, having followed the full process you are still dissatisfied, you will then have the right to direct your comments to the Information Commissioner who will give due consideration to the matter. See Appendix 'a' attached.

officer was convicted of driving with excess alcohol, failing to stop for
police and driving without due care and attention following an incident in
Northamptonshire on 16 December 2017. The officer was off duty. It is
alleged that the officer has breached the Standards of Professional
Behaviour in respect of

discreditable conduct."

 

REQUEST

1. I would like all data held relating to the driving, the arrest, and
conviction of the 'An Officer'. This includes the audio/video of the
event.

If the case is under appeal, please let me know the date you think the
case will be disposed of.

2. Are you intending to give the footage to the BBC etc. for
'Motorway/Traffic cops' etc.? If so, when is it going out?
