Please also clarify the following:

As the information is to be provided by email and there are no printing or postage costs, what are the costs quoted made up of?

The relevant ICO guidance states:
"What can be charged when the costs of compliance do not
exceed the appropriate limit
Regulation 6(3) states that this includes, but is not limited to, the
costs of:
 Reproducing any document containing the information, eg
printing or photocopying;
 Postage and other forms of transmitting the information; and
 Complying with section 11 of FOIA where the applicant has
expressed a preference for the means of communication and
where this is reasonably practicable.
These costs are referred to as ‘communication costs’ or
disbursements and are limited to expenses actually incurred.
However, public authorities should note that regulation 6(4)
prevents a public authority from charging for staff time (either its
own staff or contractors) in carrying out these activities. This means
that they should not include staff time as a disbursement even
where they would consider it as an ‘administration’ or ‘handling’ fee."

The fee quoted also includes VAT. Please also confirm that the information is available from another non-public authority source.

The relevant ICO guidances states:

"VAT
Whether or not the public authority can charge VAT depends on
whether the information is only available from the public authority
(or another public authority). If the requested information is only
available from a public authority, any charges would not attract
VAT.
However, if the requested information is available from another
source that is not a public authority, the public authority may add
VAT to its fee."

I have also supplied to the NMC a copy of the ICO's decision in the following case - which states that the time and costs of considering and redacting any information on the recording cannot be included in the assessment of cost

Further to a letter we received from the ICO; reference as above, and in
line with their following advice, -
 
  “Where possible we prefer complaints to be resolved by informal means,
and we ask both parties to be open to compromise”.
 
I have now revisited your request and reversed our position.
 
Since receiving the ICO’s letter we have identified that you were a
“party” to the proceedings in the fitness to practise case of 056135.
According to current NMC practice and policy it has agree you are entitled
to have a copy of the transcript of the hearing without a charge.
 
Please see attached the information you have requested.

Dear Clementine Adewunmi,

You have not attached the transcript of the hearing of 11 April 2017. Instead, you have attached the transcript of the hearing on 18 April 2011 (which transcript had already been disclosed as part of the restoration process).

Please send me a transcript of the hearing of the hearing in 2017. You have identified that we were a party to that hearing and so we would anticipate that such transcript to be provided as soon as possible and without charge.

Dear What Rights (M Walker)

 

In response to an email received from the ICO stating your query regarding
the incorrect transcript sent to you, please see attached the transcript
of the Restoration hearing held in public.

 

I apologise for sending the FtP transcript, it was unclear as to which
transcripts you were referring to.

 

As you know, part of the Restoration hearing was heard in private. The
transcript for this part of the hearing will not be sent to you as I am
not familiar with the security and access of the WhatDoTheyKnow website.

 

If you still require this part of the transcript please provide a private
email address or a postal address.
