Thank you for your information request which is being dealt with under the

Our initial response correctly referred you to West Sussex County Council
because TTROs under Section 16a of the Road Traffic Regulation Act are
used to deal with highway maintenance.

 

In accordance with the Council’s duty to provide advice and assistance to
requestors under Section 16 of the FOIA; I can advise you that HDC uses
Section 21 of the Town Police Clauses Act (TPCA) 1847 for temporary road
closures for the purposes of recreational use.

 

The Council aims to provide you with details of road closures in 2018
under the TPCA within the next three weeks.

Further to our acknowledgement we can now respond to your review request
about Temporary Traffic Regulation Orders.

I write to confirm that the Council has reviewed the handling of your
request for Information.

 

For ease of reference, I have set out a brief background to this matter:

 

• On 08/09/2018 the Council received your request for Information

• On 10/09/2018 the Council acknowledged your request

• On 10/09/2018 the Council responded to your request within 20 working
days referring you to West Sussex County Council (WSCC).

• On 14/09/2018 the Council received your request for a review.

• On 05/10/2018 the Council emailed you an interim response.

 

Your original request asked for the following information:

Having reviewed this matter, I can confirm that Horsham District Council
(HDC) did not make any TTRO's under Section 16A of the Road Traffic
Regulation Act (RTRA).

Section 16A RTRA states:

…(2) If the traffic authority for a road are satisfied that traffic on the
road should be restricted or prohibited for the purpose of—

(a) facilitating the holding of a relevant event,

(b) enabling members of the public to watch a relevant event, or

(c) reducing the disruption to traffic likely to be caused by a relevant
event,

the authority may by order restrict or prohibit temporarily the use of
that road, or any part of it, by vehicles or vehicles of any class or by
pedestrians, to such extent and subject to such conditions or exceptions
as they may consider necessary or expedient….

 

HDC is not the traffic authority for the above legislation, this is WSCC.
In accordance with the Council’s duty to provide advice and assistance to
requestors under Section 16 of the FOIA; I can advise you that HDC uses
Section 21 of the Town Police Clauses Act (TPCA) 1847 for temporary road
closures.

Under Section 21 of the TPCA 1847 the attached document show roads which
have been / will be closed during 2018.
