I believe any discussion between Hertfordshire County Council and Land Holdings would be of public interest to be disclosed. As the decisions being made between Hertfordshire County Council and Land Holdings could potentially affected the lives of 1000's of residents in Hertfordshire.

Please remember once information such as an email is received from a private entity to a public entity such as a County council the data can be requested in the scope of the FOI act unless you have a legitimate reason to claim an exemption.

Dear Information Governance,

I note your claim to rely on the following rule when aggregating requests:"Due to the similar nature of these requests they will be aggregated into one request with all correspondence sent to the email address provided."

However I would like you to note that you must be very careful when aggregating Freedom of information requests when you believe that they are based on similar or the same information.

According to the ico:
"‘Two or more requests’
41. Public authorities can aggregate two or more separate
requests.

42. They should also note that multiple requests within a single
item of correspondence are separate requests for the purpose
of section 12. This was confirmed by the Information Tribunal
in the case of Ian Fitzsimmons v ICO & Department for Culture,
Media and Sport (EA/2007/0124, 17 June 2008).

43. Therefore a public authority should ensure that each request
can be aggregated in accordance with the conditions laid out in
the Fees Regulations. Any unrelated requests should be dealt
with separately for the purposes of determining whether the
appropriate limit is exceeded. "

I do not believe all of the FOI requests I sent can be aggregated into a single request, as to aggregate one or more requests they must be "made for the same or similar information".

I believe you have haphazardly and incorrectly applied the aggregation rule in this case as you have relied on the requests being made for 'the same or similar information' when this is not the case, most of the requests are not for the same or similar information.

I believe the minimum amount of requests that you could aggregated my 7 FOI requests into is 4 FOI requests, not 1 FOI request. All 7 requests are likely not to return the same of similar information. Please review how you have aggregated the requests before issuing a response to each of the FOI requests. One example of how you have incorrectly applied this rule is as follows:

Your request for information has been considered under the Environmental
Information Regulations2004 and I can respond as follows:

 

1. Overnight closures were programmed to take place on the week commencing
23^rd July on the Hoddesdon Link Road for final carriageway resurfacing
works. The eastbound carriageway (towards Hoddesdon from the A10) was
closed from the evening of Monday 23^rd July – Thursday 26^th July between
the hours of 8pm-5am. This was then followed by a closure of the Westbound
carriageway (towards the A10) from the evening of the Thursday 26^th –
Saturday 28^th July between the hours of 8pm-5am. Due to the extreme
weather resulting in high road surface temperatures affecting the cooling
of the newly laid material the decision was taken to cancel the overnight
closure planned on the evening of Friday 27^th July.

 

I have attached a screenshot of the granted permit from our electronic
permitting system, specific to the works on the westbound carriageway of
Hoddesdon Link Road to which the enquiry relates to.

The contractor applied for and obtained a Section 61 notice from the local
authority responsible for environmental health, which is Broxbourne
Borough Council, details of how to obtain this information from them can

In relation to complaints I confirm that the County Council does not have
any complaints recorded for the period stated relating to construction
activities associated with High Leigh Garden Village.

 

2. in accordance with Regulation 5 (1) of the Environmental Information

requested is not held by Hertfordshire County Council, as I have not been
in a position to locate any emails or letters received before or on the
29/07/2018 to Land holdings from any employee who is employed as an

The public interest arguments for releasing this information are as
follows:

 

• To release the information would show accountability for the actions of
the Council and its officers

 

The public interest arguments for withholding the information are as
follows:

 

• That the public interest in withholding the information outweighs the
public interest in disclosing it.

• Disclosure would be an unfair and unwarranted interference with the
individual’s privacy

 

On balance we feel the public interest is better served by withholding
this information.
