Some elements of these documents have been redacted under Section 40 of the Freedom of Information Act (FOIA) – Personal Information. This exemption allows a public body to withhold information that could be considered personal to an individual. In line with the principles set out in the Data Protection Act, a public body has a duty to protect personal information that it holds.

Please note that in HG-014-08167 The Hold - 1 Activity Plan Research Appendices_Redacted Section 40 has been applied to pp.63-119 inclusive. These pages contain the full transcripts of interviews with individual members of the public and even if their names are redacted, their identities could still be extrapolated from the personal information provided. We have therefore redacted the entirety of these pages.

We have also redacted pp.43-54 of HG-014-08167 The Hold - 4 Project Execution Document_Redacted, which contains the Cost Plan, under Section 43 (2) of the FOIA- Commercial Interests. This allows us to withhold information which would, or would be likely to, prejudice the commercial interests of any person or organisation and is subject to a public interest test, which I have set out in the Appendix 1 at the end of this email. Overall we have concluded that the arguments against disclosure outweigh those in favour.

Section 43 (2) has also been applied to HG-014-08167 The Hold - 13 Business Plan_Redacted, surrounding income predictions for the Hold. The public interest test for applying these exemptions can be found in Appendix 2. Overall we have concluded that the arguments against disclosure outweigh those in favour.

In regards to HG-014-08167 The Hold - 6 Job Descriptions and Briefs_Redacted we have redacted the majority of the job descriptions and briefs within the document under Section 22 of the FOIA- Future Publication. This exemption is also qualified and the public interest test carried out for this can be found below at Appendix 3. Overall we have concluded that the arguments against disclosure outweigh those in favour. You are still able to view pp.102-112 (labelled as 100-110 on the document) as this relates to a tender exercise that has already been completed and thus is not prejudicial.

Please also be aware that whilst we do hold appendices A-N for HG-014-08167 The Hold - 9 Architectural Design Report_Redacted, they will not be sent to you under Section 21 of the FOIA- Information Accessible Elsewhere. These documents can be found on the Suffolk County Council website through this link (https://secure.suffolkcc.gov.uk/ePlannin...). The application number is SCC\0174\17 (SCC\0174\17IP). However, when testing the link I found it easier to search SCC\0174 and then ‘the Hold’s’ planning application was at the top.

• As a publicly funded organisation, the public has a legitimate interest in HLF’s activities and disclosure would increase public awareness about the work of HLF and its grantees.

Factors against disclosure
• It is not in the interests of the applicant to release this information as it could potentially undermine their commercial position for the tendering of services that are currently being negotiated.
• It is not in the interests of the applicant, the public or HLF to release this information as it could jeopardise the applicant from obtaining good value for money during the tender process.

Appendix 2- HG-014-08167 The Hold - 13 Business Plan_Redacted (s.43(2))

Factors in favour of disclosure
• Disclosing the information requested would enhance transparency and accountability.
• As a publicly funded organisation, the public has a legitimate interest in HLF’s activities and disclosure would increase public awareness about the work of HLF and its grantees.

Factors against disclosure
• It is not in the interests of the applicant to release income predictions as this could cause adverse impact on income generation due to competitors being given a commercial advantage from this information.
• It is not in the interests of the applicant, the public or HLF to release this information as it this could affect the future viability and sustainability of the Archives Service and of ‘the Hold’, jeopardising the public’s access to the facility and the investment made.

Appendix 3- HG-014-08167 The Hold - 6 Job Descriptions and Briefs_Redacted (s.22)

Factors in favour of disclosure
• Disclosing the information requested would enhance transparency and accountability.
• As a publicly funded organisation, the public has a legitimate interest in HLF’s activities and disclosure would increase public awareness about the work of HLF and its grantees.

Factors against disclosure
• All information that has been redacted will be published in the near future when job recruitment and the tender process is open to the public.
• Releasing this information ahead of the procurement process could lead to unfair advantage to any potential candidates.

I am writing to request an internal review of Heritage Lottery Fund's handling of my FOI request 'Suffolk County Council - 'The Hold' Heritage Centre: Second-round Grant Application documents':

- Firstly, I would be grateful if you could more fully explain the ‘blanket’ redactions you have made in the document ‘HG-014-08167 The Hold - 1 Activity Plan Research Appendices_Redacted’, where Section 40 of the FOIA (2000) has been applied to pages 63-119 inclusive. As you state: ‘these pages contain the full transcripts of interviews with individual members of the public and even if their names are redacted, their identities could still be extrapolated from the personal information provided. We have therefore redacted the entirety of these pages.’
However, it is clear that parts of these ‘interviews’ were used quite readily earlier in the same document, in Section 6.5 (pp.217-221 - as numbered in the document), where they have not been redacted. Therefore, even though I feel certain there will still be parts that it will be necessary for you to redact, for the reasons given; I request that you use a more detailed method of redaction for pages 63-119, inclusive.

- Secondly, I would be grateful if you could now forward me the ‘final’ Business Plan. As it is clear from the Business Plan sent with your response that it is only a draft and interim document. Indeed, it states this in the document itself (Section 2), that it is only an ‘interim business plan for The Hold’ detailing only the chosen consultant’s ‘preliminary findings’. Before stating further how they will ‘further develop all sections of the final business plan’.

Many thanks for your emails of 17 August. You asked for an internal review of our FOI responses. I attach a response from our Chief Executive, Ros Kerslake, along with two documents (appendices 5 and 6).

You also asked for a number of items of new information across your two email which I will address below.

1. A list of all documents received from the grantee with their first round application.

Please find this attached. Personal information has been redacted in line with Section 40 (personal information) of the Freedom of Information Act 2000.

2. A copy of the Transformation Plan and information about the Organisational Change Consultant, the recruitment of who was mentioned in the first round application.

I can confirm that we do not hold this information. Suffolk County Council have informed us that this work did not take place.

3. Other documents relating to wider organisational change and transformation of the current Suffolk Record Office service.
