Freedom of Information request: FOI|83|18
I am writing in response to the Freedom of Information request you submitted to this office and
dated 03 June 2018 Which is copied in bold below;
I understand that some Documents relating to the prosecution of Nazi War Criminals after the Second
World War, including some concerning the torture and kil ing of British and French Citizens/Soldiers
during and after the War in North-East France, were subject to a 75 Year Classification for their
release:-
1. How many documents that come into this 75 Year Classification are stil to be released by the
British Government?
2. What are the Titles/Subjects of the documents stil to be released?
3. When are the remaining documents to be released?
4. Are there any plans to introduce legislation in the U.K. similar to the United States War Crimes
Disclosure Act?
The Freedom of Information Act (2000) gives individuals and organisations the right of access to
all types of recorded information held, at the time the request is received, by public authorities
such as the Attorney General's Office (AGO).
I have now been able to consider your request and can confirm under section 1(1)(a) of the Act
the AGO does not hold the information you have requested. It may help if I clarify that the
information being requested is not held by the AGO because there is no legal or business
requirement for the AGO to do so.
Please be advised that the FOIA does not oblige a public authority to create information to
answer a request if the requested information is not held. It does not place a duty upon a public
authorities to answer a question unless the recorded information exists or is held at the
department. The FOIA duty is to only provide the recorded information held.
If you are dissatisfied with the handling of your request, you have the right to ask for an internal
review. Internal review requests should be submitted within two months of the date of receipt of
the response to your original letter and should be addressed to the above address.
Please remember to quote the reference number above in any future communications.
If you are not content with the outcome of the internal review, you have the right to apply directly
to the Information Commissioner for a decision. The Information Commissioner can be
