For each of the specified incinerators please can you provide results of the soil analyses from surrounding receptors, specifically data identifying chemicals or heavy metals that have been detected at levels which exceed permit limits or reached a level considered to cause contamination of vegetation

We respond to requests under the Freedom of Information Act 2000 and
Environmental Information Regulations 2004.

The Isle of Wight Waste Recovery Park (Please see our responses in bold)

 

The information sought is as follows:

- number and nature of permit breaches for each plant location (since 
operation began)  NONE – not operational

- number and duration in hours of EA permit assessments made at each
plant  facility per year since operation (specifically emissions and
pollution  assessments )  NONE – not operational

- number and nature of EA enforcement notices for each plant location 
(since operation began), including whether they are unresolved or resolved
NONE – not operational

- number and themes of public complaints for each plant facility since 
operation began  NONE – not operational

- number and nature of HSE incidents at each plant location (since 
operation began)  Not operational

- any extensions  to the incinerator permit that have been granted to or 
applied for by Amey (for each plant facility).  See above, permit
variation and consolidation was granted in November 2017.

 

Site in Milton Keynes (Please see our responses in bold)

 

In addition please find responses to the specific queries below for the
facility in Milton Keynes:

- number and nature of permit breaches for each plant location (since 
operation began)

Commissioning of this site was only completed in January of this year, as
a result the plant was only considered as operational since that time.
Since then we have identified three breaches of the environmental permit,
two related to a spillage incident and one was in relation to the sites
complaint response actions.

- number and duration in hours of EA permit assessments made at each
plant  facility per year since operation (specifically emissions and
pollution  assessments )

Commissioning of this site was only completed in January of this year, as
a result the plant was only considered as operational since that time.
Since January 2018 we have undertaken one site inspection lasting 2 hours
and one procedure review taking 7.5hrs. Prior to this, during the
commissioning phase we undertook 3 site inspections and three procedure
review.

- number and nature of EA enforcement notices for each plant location 
(since operation began), including whether they are unresolved or resolved

None

- number and themes of public complaints for each plant facility since 
operation began

Since the permit was issued in 2013 we have received approximately 14
odour complaints, 1 complaint of dust and 4 complaints of flies. Please
note that not all of these reports were substantiated or confirmed to the
resulting from the Amey site.

- number and nature of HSE incidents at each plant location (since 
operation began)

None

- any extensions  to the incinerator permit that have been granted to or 
applied for by Amey (for each plant facility)

None

 

Allerton Waste Recovery Park

 

Number and nature of permit breaches for each plant location
(since operation began)

Commissioning of the plant began in 2017 and there were 11 breaches during
this period. The majority of these were for CO breaches from the
incineration line or biogas release during commissioning of the Anaerobic
digestor. So far in 2018 the site have submitted Schedule 5 notifications
for 8 breaches. Several of these are still under investigation. Of these
breaches the majority have been for carbon monoxide breaches and loss of
the Continuous Emissions Monitoring (CEM) system. 

 

Number and duration in hours of EA permit assessments made at each
plant facility per year since operation (specifically emissions and
pollution assessments)

No Compliance Assessment Plan was prepared for the site during 2017 as the
site was under construction for the majority of the year. However, there
were 5 site inspections during 2017. So far in 2018 there have been 45
hours of compliance activity.

 

Number and nature of EA enforcement notices for each plant location (since
operation began), including whether they are unresolved or resolved

As of the date of your request, there have been no enforcement notices
issued to the site.

 

Number and themes of public complaints for each plant facility
since operation began

Since commissioning began there have been 22 complaints from the public.
The vast majority of these complaints were due to odour. None of these
complaints were substantiated.

 

Number and nature of HSE incidents at each plant location (since operation
began)

Unfortunately we do not hold this information and we would recommend
contacting HSE directly for this.

 

Any extensions to the incinerator permit that have been granted to
or applied for by Amey (for each plant facility)

There have been no extensions to the permitted installation boundary.

 

With regard to your request for HSE incidents, we have considered your
request under the provisions of the Freedom of Information Act 2000 /
Environmental Information Regulations 2004 (EIR). The Act requires that we
respond to requests by advising you whether or not information is held,
and if so by providing you with that information.

EIR Regulation 3(2) states that information is held if it is in our
possession and has been produced or received by us, or it is held by
another person on our behalf at the time the request is received.

 

Information not held

In this case, some the information you have requested is not held by the
Environment Agency, and we are therefore partially refusing your request
on the grounds that there is no information we can provide.

 

Where a request is for environmental information, the Regulations allow us
to refuse to disclose it if the exception at EIR Regulation 12(4)(a)
applies. The regulation states that a public authority may refuse to
disclose environmental information to the extent that it does not hold
that information when an applicant’s request is received.

 

It is not possible for us to conduct a public interest balancing test
because the reason for non-disclosure is that the information is not
held.

There is no permit requirement for the above sites to undertake soil
monitoring. We do not hold any information in relation to this and
therefore there are no soil analysis results we can provide you with.

 

We have considered your request under the provisions of the Freedom of

The Act requires that we respond to requests by advising you whether or
not information is held, and if so by providing you with that information.

Can you please confirm your definition of resolved and unresolved.

 

“resolved” may relate to an issue which led to a permit breach but which
has now been “fixed” and is therefore unlikely to occur again

“unresolved” may relate to a breach which is still being investigated
and/or which may occur again

 

Please reply to confirm your definition of resolved and unresolved, once
we receive your clarification we will finalise your request for

Environmental Information Regulations 2004.

 

I apologise for our delay with this response.

 

Please see comments below from each of the relevant permit teams:

 

Yorkshire area, Allerton Waste Recovery Park Moor Lane, Knaresborough HG5
0SD:

 

Details of resolved/unresolved breaches. All are now resolved (ie a part B
notification has been submitted) with the exception of 2 loss of
monitoring equipment which is awaiting a full report.

 

Secondly, there have been 8 new notifications since the last request. The
majority of these are for exceedence of the half hourly Carbon Monoxide
limit due to plant blockages.

 

East Anglia area,  Milton Keynes Waste Recovery Park, 9 Dickens Road, Old
Wolverton, Milton Keynes, MK12 5QF also Amey’s waste management park,
Waterbeach, Cambridge CB25 9PQ:

 

There are no new or unresolved permit breaches at the Milton Keynes site.

 

At the Waterbeach Waste management park there is 1 permit breach at each
of 3 of the permitted facilities, that could be interpreted as being
unresolved. One breach relates to odour management at the In vessel
composting site and one at the permitted MBT plant, again related to the
odour management of the biofilter. The other breach relates to groundwater
trigger levels around the landfill.

 

Solent South Downs area, Isle of Wight Waste Recovery Park, Forest Road,
Newport, Isle of Wight PO30 5YS:

 

No breaches have been recorded.

Dear National Requests,

I am concerned that Amey Cespa has not disclosed to the public the truth about unresolved breaches at the Waterbeach Waste Management Park, Cambridge. In fact when interviewed by several local newspapers they stated “the company has addressed all the EA’s issues “to their satisfaction” and were considered a “competent operator”. And “We did this and have addressed all the issues identified to their satisfaction. Therefore, the Environment Agency continues to consider us as a competent operator. We are committed to minimising the impact of our activities on local people and the environment.”

“The spokeswoman acknowledged there had been breaches, including three at a facility in Milton Keynes, but that the company had “reviewed and updated” its systems as a result. She said other breaches, including a carbon monoxide breach at its site in Knaresborough, have also been “rectified”.”

I am concerned that Amey have grossly misinformed the press. They have clearly said that all breaches at Waterbeach were resolved yet my FOIR states that was not the case. The further question I sent and which was answered by you in Sept 2018 confirms that of the breaches disclosed in my FOI, there were unresolved breaches.

They have openly misinformed the press and public in an attempt to cover up outstanding breaches. It is grossly unprofessional and inappropriate for a company to misinform the public in such a way.

I would like to ask please what the EA intend to do about this? What action will be taken against Amey for bending the truth?

Dear Enquiries_EastAnglia,

Will you be taking any action about the claims they made to media , where they said all breaches had been resolved and the EA was satisfied as such? This contradicts completely with the FOI information you sent me. They should not be claiming no ongoing breaches when at the time there were several unresolved breaches.

If you intend to take no action please explain clearly why?

I have provided clear evidence of the company claiming no outstanding permit breaches when there were asper the FOI clearly ongoing breaches .

Does this not warrant a stately from the EA?

If not please clarify why as I’m confused by your reply.

If not the EA then who should I contact to discuss the inaccurate statement provided to local media by Amey Cespa?
