2) Can you provide the name of the Officer from the Waltham Forest Council who had instructed the Barrister and how many years has he/She worked for the Council.

3) Please kindly provide the name of the District Judge who had made the Liability Order and the name and address of the Magistrates Court.

4) How many persons have been sanctioned under Section 2 of the Mental Health Act 1983 for non-payment of Rent and or Council Tax Arrears in the past three years.

Dear Waltham Forest Borough Council,

I, Ismail Bhamjee request your attention and consideration that there is Section 151 of the Senior Courts Act 1981 and there is a Legal Right to make an Application for Judicial Review in the High Court or the Upper Tribunal which should be taken into consideration as well.

The Mental Health Act 1983, and the New Rules for Court of Protection which comes into force on the 1st December 2017, this does allow non-party to make an Application to the Court of Protection whilst the Court of Protection Judge can make any Order which could be made in the High Court of Justice under the Civil Procedure Rules. In the Mental Health Act 1983, there is the word Close Relative which have been stated.

I am writing to request an internal review of Waltham Forest Borough Council's handling of my FOI request 'RE: Payments made to the Barrister Mr P.Stagg High Court of Justice Francois V Waltham Forest Council and Statutory Instrument 2012 No 2886'.

1. I believe that when the Local Authorities does apply for the Council Tax Liability Orders, there are usually more than 100 Summons for the Liability Orders, whilst the Magistrates Courts does not keep the records as copies are kept by the Local Authorities.

2. The Local Authorities does have the Social Workers, who normally makes the Applications or Complaints for the person to be detained under the Mental Health Act 1983 for a period of 28 days for assessment.

3. Under the Mental Health Act 1983, there is a legal Right for Son or Daughter, Brother-Sister, Mother, and other relatives who can make an Application to the Court.

4. You are aware that there are time limits as well when a person can make an application to the Court, as the delays has been caused by your Office, since Section 64 of the Senior Courts Act 1981 and the CPR 19 Rules does apply for the purpose of saving time and Costs, against the Local Authorities , the Hospital Trust.
and The Secretary of State for Health under the Human Rights Act 1998.
