Freedom of Information Act 2000 – Request for Information
Wales Creative IP Fund
I refer to your e-mail referred to Finance Wales on 18th August 2010 in which you
requested in relation to the Wales Creative IP Fund since its establishment:-
1. The names of all appointees to the Fund's Investment Committee, dates of
appointment and the process undertaken to appoint them.
2. The total cost of fees and expenses paid to members of the Fund's Investment
Committee.
3. Details of fees and expenses paid to each individual member of the Fund's
Investment Committee.
4. Details of any declarations of interest made by members of the Fund's Investment
Committee.
In response to your request information which can be disclosed has been provided along
with details of any exemptions applied –
1. Membership of the Wales Creative IP Fund Committee and the dates of appointment
are as follows:
Clive Jones – Chairman (01.04.05 – present)
Peter McInerney (01.04.05 – present)
Ian Jones (01.04.05 – present)
Gawain Hughes (01.04.05 – present)

As a matter of policy recruitment documentation is destroyed 12 months after a post has
been filled, therefore Finance Wales does not hold details of this specific recruitment
process.
2. The total cost of fees and expenses paid to the Fund’s Investment Committee is
£59’774
3. Finance Wales considers details of fees and expenses paid to individuals to be exempt
under section 40(2) of the Freedom of Information Act 2000. Section 40(2) provides that ‘If
the personal data is about someone other than the applicant, there is an exemption if
disclosure would breach any of the Data Protection Principles’. In this case, the
information is such that in our view, its release would breach the Data Protection
Principles. This is an absolute exemption.
4. Details of Declarations of Interest are detailed in Appendix A along with the Fund’s
Declaration of Interests Policy and log in Appendix B. In practice, papers are sent out to
those committee members available a minimum of 24 hours prior to a meeting. Conflicts of
interest are usually announced prior to the meeting and an alternative member of the
committee is sought to replace the conflicted member.
Your request has been considered according to the Freedom of Information Act 2000
principles set out in the National Assembly for Wales Code of Practice on Public Access to
information (third edition) the Code is published on the internet on:

If you believe that Finance Wales has not applied the Code correctly or has not followed

Declarations of Interest
Investment Committee & Board Members Responsibilities
In accordance with the terms of your appointment as a Board or Investment Committee
Member of the Wales Creative IP Fund you are required to fully disclose your existing
business, financial and other interests to the Fund.
On an on-going basis you are also required to inform the Wales Creative IP Fund of any
significant changes arising during the period of your appointment.
Accordingly you should notify the Fund Co-Ordination or the Chairman of the Board or
Investment Committee at the earliest opportunity of any possible conflicts of interest
between your financial and other interest and your functions and responsibilities as a
Board or Committee Member.
Fund Responsibilities
The Wales Creative IP Fund will maintain a register of Declarations of Interest and will also
include ‘Declarations of Interest’ as the first Agenda item at all meetings.
