Dear Mr Skene

I am writing further to our email dated 30 July 2010 in which we
acknowledged your request for information to the Information
Commissioner’s Office (ICO).

You referenced a previous response we had provided in relation to our FOIA
“lines to take”.

Specifically you then requested “your most recent set of these,
highlighting those which have been updated since you released the previous
set”.

You request has been considered under the Freedom of Information Act 2000
(the FOIA).

In response, I am able to provide copies of our lines to take, which
capture the Commissioner's approach to issues that have arisen in casework
or as a result of Tribunal decisions. Due to the size of the documents, it
has been necessary to send the information in 7 separate documents and I
will need to email them from a separate email address. Shortly after you
receive this communication, you will therefore receive 7 separate emails
with attachments from [2][email address]. I do hope this is
not inconvenient.

As you will see, there have been a significant number of additions to the
list since 2007. As you appear to have access to the previous release, I
trust you will be able to identify the updates.

I have noted your comments regarding publishing the lines to take on our
website. This is currently under consideration and I appreciate you taking
the time to provide some feedback.

You will note there are some minor redactions where we have removed the
names of third parties who made complaints to the ICO. 

Section 40(2) of the Freedom of Information Act 2000 (FOIA) allows a
public authority to withhold information from a response to a request
under the FOIA when the information requested is personal data relating to
someone other than the requestor, and its disclosure would contravene one
of the Data Protection principles.

We consider that when individuals make complaints to the ICO they do not
anticipate or expect the details of their complaints, or any actions taken
by the data controller concerned or the Information Commissioner in
connection with their complaints, to be disclosed to anyone else. 
Therefore, we consider that such a disclosure would be unfair and in
breach of the first Data Protection principle which states that –
“Personal data shall be processed fairly and lawfully …”

Complaints Procedure

I hope this information is of help and assistance.  If you are
dissatisfied with the response you have received and wish to request a
review of our decision or make a complaint about how your request has been
handled you should write to the Internal Compliance Team at the address
below or e-mail [3][email address]

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to the Case Reception Team, at the address below or visit the
‘Complaints’ section of our website to make a Freedom of Information
Act or Environmental Information Regulations complaint online.

Many thanks for sending the Lines To Take LTT1-177 which I found very useful & informative.

There appeared to be a couple of scanning issues with a small minority of the LTT documents. I'd be very grateful if you could review (hopefully informally without needing to trigger your internal review processes) & re-send the LTTs below:-

1) LTTs apparently "missing" from the sequence 1-177:

* LTT10 (in doc #1 of 7)
* LTT140 (in doc #5 of 7)

2) Left or right-hand side of document cut off in the PDF, making it hard to follow the text:

* LTT13 (in doc #1 of 7)
* LTT14 (in doc #1 of 7)
* LTT104 (in doc #3 of 7)
* LTT105 (in doc #3 of 7)
* LTT115 (in doc #3 of 7)
* LTT131 (in doc #4 of 7)
* LTT148 (in doc #5 of 7)
* LTT149 (in doc #5 of 7)

3) Other Issues:

* LTT133 (in doc #4 of 7) - diagram not scanned to pdf properly - all appears to be blacked out.

* LTT43/44, LTT57/58, LTT58/59 (in doc #2 of 7). Due to the right-hand side being cut off, it makes it impossible to assign the LTT number to the correct document. This also leads to one of 43/44 being "missing", and one of 57, 58 & 59 also "missing".

Apart from the diagram in LTT133, please could you re-send all these documents in a plain-text format? Many thanks in advance for your assistance.

I write further to my email dated 23 September 2010, in relation to your
earlier request for information. Please accept my apologies for the
slightly delayed response; I have been out of the office recently.

Please find attached the re-scanned lines to take (LTT).

For clarity I will address each of the numbered comments in your email
dated 17 October 2010.

With regards to point 1, I can confirm that there is no LTT10, as this has
been withdrawn from use. I have attached LTT140.

With regards to point 2, the attachment “Revised lines to take”
contains LTT13, LTT14, LTT104, LTT105, LTT115, LTT131, LTT148 and LTT149.

With regards to point 3, I have attached LTT133. For completeness I have
also attached a re-formatted copy of LTT43, LTT57, LTT59 and LTT60. LTT44

and LTT58 have also been withdrawn and hence are not attached.

Unfortunately I am unable to send the LTT’s in a plain text format. To
ensure the integrity of the information, we send such responses in the
standard PDF format. I can confirm that you may re-use the information in
line with our re-use conditions.
