Please be advised that there are no records held, and the Council has no
policies on acquiring properties (commercial or residential) that have
been repossessed.

 

How much Wandsworth Borough Council has spent on purchasing residential,
"repossesed" properties in 2016?

£ 990,000 in total.

 

How many residential, "repossesed" properties Wandsworth Borough Council
has purchased in 2016?

2 properties at auction.

 

Provide copies of the insurance policy for the purchased residential,
"repossesed" properties in 2016.

Please refer to the attached document which incorporates two leasehold and
one tenanted property insurance schedule as these are “blanket” insurance
cover for Council properties and would include any that have been
purchased which were re-possessed.  These have all been redacted of
insured sums and therefore are being withheld under section 43 (Commercial
Interests) of the Freedom of Information Act 2000.

 

Section 43 states that information is exempt from disclosure if its
disclosure would, or would be likely to, prejudice the commercial
interests of any person, including the public authority holding it. 
Disclosure of the insured sums would be likely to prejudice the Council’s
ability to secure and negotiate the best possible insurance rates for any
future properties that it has ownerships of.  Different rates would have
been negotiated and agreed with the Insurance Company concerned and
dependent on the type of tenancy being covered, whether this be Leasehold
or Tenanted.  To release this information into the public domain could
also undermine the negotiating process of the Insurance Company concerned
as their competitors might be able to strengthen their conditions of
insurance should this come up for revision at the end of the current
insurance terms.

 

This exemption requires the Council to consider the public interest test
and, whilst the Council recognises the public interest in the transparency
of this process, it must consider the strong public interest in securing
best value for tax payers in the Borough.  In order to ensure best value
the Council must be able to negotiate and agree these rates without the
information being placed in the public domain; as a consequence, the
greater public interest lies in withholding these parts of the requested
information.

No individual is responsible for authorising payments. These are subject
to committee or delegated authority as per item 6 below

68 Harbridge Avenue = Andrews (Putney)           21 Wye Street = Barnard
Marcus (Hammersmith)

I am aware that you have previously been informed (under reference
2016/13809) that these properties were purchased at auction. Further to
this request it has now been confirmed that both properties were purchased
by private treaty. 21 Wye Street went to auction and failed to sell prior
to the auction dated 15th December 2015. The sale of 68 Harbridge Avenue
was agreed simply via private treaty.

 

5.    Provide full name of the Council's officials who attended the
Auctions?

N/a.

 

6.    Provide the reasons for purchasing the properties by the Council's
officials when the Council  has no policies on acquiring properties
(commercial or residential) that have been repossessed?

The Council has a number of strong policies on acquiring
property(repossessed or any other) given the strong commitment to Housing
and regeneration within the Borough. These policies are authorised via
committee papers authorised by the Executive.

This is delegated to officers by virtue of the attached report

Payments were approved by Tunde Ogbe, Head of Valuation and Asset
Management Services who acted in line with authorities/delegations. The
approval of these payments were not decided by the Chairman/Executive.

or any other) have been authorised by the Executive of the Executive?

The acquisition of 68 Harbridge completed on 27th July 2016 and 21 Wye
Street completed on 3rd March 2016. As mentioned in Q4, the approval of
these payments were not decided by the Chairman/Executive.

The conveyancing was handled by WBCs in-house legal team.

Dear Freedom Of Information,
Wandsworth Borough Council Executive Officials claim to have a policy approved and authorised by executives and councillors to purchase properties to accommodate homeless people.
They also claim to have a budget on annual bases approved and authorised for the above mentioned policy.
My property 21 Wye Street,London,SW11 2SN was stolen from me on 04.05.2016 using fraudulent documents and brutal force. My tenants were deprived of their tenancy rights.
Wandsworth Borough Council Executives claim they purchased property for £640,000 to accommodate homeless people.To this very date the property has been empty and the executives failed to provide the factual evidence and proof of the funds transfer.
The executives are responsible and accountable for the storage and accuracy of the data on the Council's data base.

Sitexorbis are on a spot purchasing arrangement by the Council to secure
the property until it was sold, Subject to Contract (STC). As this is a
shared equity property, the Council maintains this contract and will do
until works are completed and the new owners move in.

Since May 2016, there were 22 monthly invoices totalling £7,233.79 – 21x

There has been no trust created. The property has been sold as a shared
equity property. The Council (Housing and Regeneration Department) retains
a proportion of equity in the property alongside the leaseholder.

There are necessary works being undertaken at the property which require
the property to remain boarded until it is habitable.
