Thank you for your request for information which was received on 9 June 2016 requesting
information regarding Air Conditioning Assessments.
In accordance with S.1 (1) (a) of the Freedom of Information Act 2000 (FOIA), I can confirm
that we do hold some of the information relevant to your request.
1. It is a legal requirement that you hold valid TM44 Air Conditioning Assessments if any
building has a total of more than 12kw of air conditioning present. Certificates are valid
from 5 years of the issue date. Have you undertaken a TM44 Air Conditioning
Assessments?

2. Who is the responsible person for ensuring that your buildings are surveyed and
assessed, please provide the name, address, email address and telephone number of the
responsible person.

6. How many Certificates were produced?
With regard to providing the number of certificates produced. A public interest test has
been undertaken and from the results of that test it is clear that releasing this information
would be detrimental to the commercial interest of Kettering General Hospital NHS
Foundation Trust as it would identify the cost per certificate. As a result the Trust applies
the exemption allowed to us under the Freedom of Information Act 2000, Section 43(2) –
Commercial Interest as disclosure would/could:
a)
Prejudice any contractors competitive edge in contract negotiations with NHS
Trusts in the future
b)
Prejudice the Trust’s ability to compete in contract negotiations for these services
in the future.
c)
Prejudice the position of Kettering General Hospital NHS Foundation Trust in
maintaining its competitiveness as a Public Authority.
