I write in connection with your request for information dated and received
in the Freedom of Information Unit at Dyfed-Powys Police on 04 April 2016
regarding Operation Kestrel.

 

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

 

Dyfed Powys Police are unable to establish whether or not it holds the
information you have requested, since we consider that the Section 12 (2)
exemption the Cost of Compliance exceeds the Appropriate Limit applies to
it.

Where exemptions are relied upon Section 17 of the Freedom of Information
Act 2000 requires Dyfed Powys Police, when refusing to provide such
information (because the information is exempt) to provide you the
applicant with a notice which:   (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.

 

Please see the attached response document which indicates the time
estimated by the Force it would take to complete the request as a whole
and the exemption applied concerning the non-release of the information in
its entirety.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for the whole of this request under Section 17(5) A
public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with section 1(1), give the applicant a notice stating
that fact. You may wish to refine and resubmit your request so that it
reduces the time shown above to fall within the 18 hours. However having
due regard to the time estimate provided above it is unlikely that
refining your request will fall under the 18 hours as the same method and
format will have to be undertaken. Should you require any further advice
in relation to this matter please don’t hesitate to contact me?

 

Although excess cost removes the forces obligations under the Freedom of
Information Act to provide any further information, as a gesture of
goodwill, I have provided information, relative to your request which has
been easily retrievable and outlined in the response. I trust this is
helpful, but it does not affect our legal right to rely on the fees
regulations for the remainder of your request.

Dear FOI,

There is no reason why this request cannot be answered under normal cost limits. I asked;

1. What date did Deputy Chief Constable Carl Langley first become aware of and / or involved with
Operation Kestrel?

2. Supply dates of all meetings and / or discussions between Deputy Chief Constable Carl Langley
and the force's director of legal services, Samantha Gainard, concerning Operation Kestrel?

The request has not been dealt with properly and could very easily have been answered by putting the questions to DCC Langley and Ms Gainard. Alternatively, there are systems in place which will have this information recorded and where it would be easily accessible.

The calculation you have given regarding costs of dealing with this request are grossly exaggerated and would not be necessary. I would like an internal review. The questions should be put directly to DCC Langley and Ms Gainard as this would be the most appropriate and obvious, as well as cost effective way to deal with the request.

Our understanding of the situation is that you are unhappy that the
information you requested has not been disclosed. Dyfed Powys Police will

Dear Ms Young,

 

I refer to your request for Dyfed-Powys Police to review its previous
response in connection with your request for information dated 4^th April
2016.

 

I have taken into account your arguments for disclosure as set out in your
email dated 5^th May 2016 and note that you believe that disclosure should
be provided.

 

I am in a position to inform you that Dyfed-Powys Police has now completed
its review of the case. I can advise you that after careful consideration
the outcome of the review was to uphold the original response provided.

 

This decision was made on the basis that I believe that the exemptions
applied being Section 12(2) Cost of Compliance was the correct exemption
to apply. The total of 755 emails relates to those between Director of
Legal Services and DCC Langley either directly or CC’d. Furthermore, that
emails may be captured by the request but do not specifically mention the
operation name in that particular correspondence. It would require
researching each email.

 

I am satisfied therefore with the response provided by the Freedom of
Information Unit.
