28 days window rules in 10 year long residencey ILR if current visa going to expires 16 days before completing 10 years

We're waiting for faisal mehmood to read a recent response and update the status.

Dear Home Office,

One of the eligibility requirement is 10 years lawful residences,
but an application can be made upto 28 days before the 10 years

My Question is: In meeting this requirement, must the applicant
have a valid visa for the whole 10 years OR is an applicant still
eligible if the current visa runs until 10 years less 28 days (9
years 11 months and 2 days) 28 days short of the 10 years

For Instance. (For illustration purposes)
Visa Granted : 11/1/2011
Entered UK legally: 28/1/2011
Current visa expires: 12/01/2021
16 days short of 10 years, and also visa going to expires before applying but with in 28 days.

1:From the above scenario is the applicant eligible for SET (LR)
from 28/01/2021? despite the current visa 16days short of 10years.?

2: Is the applicant eligible to make a premium service application
from the 11/01/2021?

3- can applicant apply ILR before expire of visa at 11/01/2021 online?
