The new remand framework for children. (Remand to youth detention
accommodation- “YDA”)
ss91, 98-102 Legal Aid, Sentencing and Punishment of Offenders Act 2012(LASPO)
To be eligible for R to YDA a child must:-
STEP ONE Be aged between 12 and 17
AND
STEP TWO Satisfy the legal representation conditions
AND
STEP THREE ……. EITHER:-
Offence conditions:
(a)Violent or sexual offence or
(b)Offence carrying14 yrs+ for an adult.
OR:-
History conditions:
(a) Has a recent history of absconding while on remand to YDA or LAA, AND is
charged with or convicted of an offence which was committed while remanded to
LAA or YDA OR
(b) Is charged with or convicted of an offence which taken together with previous
convicted imprison able offences amounts (or would amount if convicted) to a recent
history of committing imprison able offences while on bail or remand to LAA or
YDA
AND
STEP FOUR……..EITHER
a) It is necessary to protect the public from death or serious personal injury
OR
b) It is necessary to prevent the commission by the child of further imprisonable
offences.
