Dear Calderdale Metropolitan Borough Council,

We write to request all information held relating to discussions between Bardsley Construction Ltd (and anyone representing them, or authorised to speak to CMBC), YorBuild/YorHub, and any other person or organisation which CMBC corresponded with in relation to the contract awarded to Bardsley Construction Ltd for the construction of a new primary school to be situated at the proposed site of "Halifax Academy".

This information should include, but is not limited to:

1) All correspondence between the above parties, and any other party, in relation to this. This should include correspondence from all stages of the contract awarding procedure.

2) Any details of "Corporate Hospitality" offered by, or enjoyed by, any of the above parties, whether to each other or via third parties, which was in relation to this contract.

3) Details of CMBC's procurement processes and procedures, especially in relation to construction works.

4) The exact brief, and other information, which was put out to tender for this job.

5) The exact brief/specification, and other information, on which terms and final costs have been agreed, i.e. what have Bardsley Construction Ltd agreed to deliver in fulfilment of the contract.

6) Details of any other quotes or prices that CMBC received for the construction contract which was eventually awarded to Bardsley Construction Ltd.

7) Details of any conflicts of interest, potential or otherwise, which arose during the process of procuring and agreeing the services from Bardsley Constuction Ltd/YorBuild.

8) Details of any person working for or on behalf of CMBC whom has, or had at the time CMBC were in discussions with them, family members or friends working for one of the third party organisations mentioned in this letter, i.e. Bardsley Construction Ltd and YorBuild/YorHub.

9) Details of CMBC's Due Diligence guidance in relation to construction procurements, along with evidence that CMBC followed its own guidance in this instance.

Will you inform us as to which question(s), or part of a question, the Council has identified which may fall under an exemption?

Thank you for your belated response. We are concerned that certain information has not being given as requested, and that some answers are ambiguous. As such, we have listed below the issues we have with your response.

1) In relation to point 8), which asked for "Details of any person working for or on behalf of CMBC whom has, or had at the time CMBC were in discussions with them, family members or friends working for one of the third party organisations mentioned in this letter, i.e. Bardsley Construction Ltd and YorBuild/YorHub" you state "None of the officers working on this project".

This is not the information that we requested and we would still like to know if ANY officers, not just those involved with the project, or other people deemed to be working for, on on behalf of, CMBC had any family members or friends working for the organisations mentioned.

2) In relation to point 9), which requested "Details of CMBC's Due Diligence guidance in relation to construction procurements, along with evidence that CMBC followed its own guidance in this instance", you have not supplied the information we have requested.

Please supply us with details of CMBC's processes relating to construction procurements, and evidence that these processes were indeed followed in this instance. The link you provided relates to the Yorbuild framework and not CMBC's own practices, which is what the request asked for.

We trust this feedback clarifies our request and will help you to identify the information requested and supply that without any further delays.

Thank you for your email.

Regarding point 1 below, I advise that we do not hold this information. For your information, as at 31/12/2014, the total number of full time CMBC staff was 1799 and the total number of part time staff was 1491. There is no business requirement to gather and keep information from each Calderdale Council employee as to where their friends and family members work.
