Data collected during a WCA that is terminated

Dear Department for Work and Pensions,

I am writing to request information under the Freedom of Information Act 2000. I am outlining my query as specifically as possible.

If a WCA is terminated by either the claimant, the examining HCP or a member of MEC staff, what happens to the data from the assessment that has already been entered into LiMA (or collected clerically)? Under these circumstances, what information must the MEC return to the DWP? The contract between Atos and the DWP clearly states that 'Upon completion of all the necessary actions, the CONTRACTOR shall return all documentation received from or gathered on behalf of the AUTHORITY.' Does this include data collected in a WCA that is terminated? Should such data be appended to the claimant's record?

I am interested in any information held by you regarding my request. I understand that under the Act, I do not have to specify particular files or documents and that it is your department's responsibility to provide the information I require. If you need further clarification, please contact me by e-mail.

If my request is denied in whole or part, I ask that you cite one of the Freedom of Information Act exemptions for each piece of information you refuse to release. I would also expect you to release all non-exempt material. I reserve the right to appeal your decision to withhold any information or to charge excessive fees.

I should be entitled to a response within 20 working days. I would be grateful if you could confirm in writing that you have received this request. I look forward to hearing from you.
