financially and giving approval that the scheme will work.

The land is owned by the council and the surface water runs off and floods the nearby properties.

The council put a bund a long the fence of their field in 2007 and told the residents that it would stop the flooding problem.

It didn't stop the surface water.

defence grants and the management of surface water flooding.

 

The Environment Agency is responsible for allocating central government
funding to manage flood and coastal erosion risk in England using the
partnership funding approach.

 

This funding is known as flood and coastal erosion risk management grant
in aid (FCRM GiA). It goes to flood risk management authorities (RMAs) -
that is, the Environment Agency and English local authorities and internal
drainage boards (IDBs). Together, they use it to pay for a range of
activities including schemes that help reduce the risk of flooding and
coastal erosion.

 

When we allocate FCRM GiA to flood risk management authorities, we follow
government policy and guidelines set out by Defra.

Authorities (LLFAs) were given overall responsibility for managing the

INFORMATION REQUEST: FUNDING FOR STOPPING FLOODING.

Thank you for your request for information, received in this office on 31
March 2014.

 

I have consulted our Flood and Coastal Risk Management team and they have
provided the following information:

 

Is it true the EA needs to approve financially and giving approval that
the scheme will work?

Under the Flood and Water Management Act 2010, Lead Local Flood
Authorities (the unitary authority or County Council for the area) have
powers to carry out flood risk management works relating to surface water,
ground water and ordinary watercourses. Lead Local Flood Authorities can
apply for an allocation of government funding annually from the
Environment Agency. This central government funding is called Food and
Coastal Erosion Risk Management Grant in Aid (FCERM GiA) and the
Environment Agency administer this grant. Any project funded (either whole
or in part) by FCERM GiA must have technical and financial approval. To
gain this approval projects must go through a project appraisal stage and
be approved by either the Environment Agency’s Project Assurance Board or
the Environment Agency’s Large Project Review Group. This is the process
for projects which are funded by FCERM GiA. If Lead Local Flood
Authorities carry out work which are funded by other means, then the
Environment Agency is not involved in the appraisal or approval process.

 

Is it true that the E.A is responsible for granting and checking proposed
flooding schemes put to them by local council for funding?

responsible for surface water that comes off land that is owned by local
council?

The riparian land owner (in this example, the local authority) has a
natural right to collect and discharge surface water from their land onto
adjoining lower land. This right does not permit an owner to act in a
wilful manner. A lower occupier of land is under no obligation to receive
water and can take steps to stop the flow of water onto this land. Further
information on the roles and responsibilities of riparian landowners can
be found in our publication ‘[1]Living on the Edge’ (attached). Under the
Flood & Water Management Act 2010, Lead Local Flood Authorities (the
unitary authority or County Council for the area) have powers to carry out
flood risk management works relating to surface water, ground water and
ordinary watercourses.

 

Is the council responsible for stopping the surface water running off the
land they own.  I am being told it is down to land owner is this true?
