I am writing to request under the freedom of information act any/all copies of administrative correspondence, letters and/or any other documentation including minutes of meetings etc that mention or relate to:

HIV / AIDS or Hepatitis, AND, Haemophilia / Haemophiliacs during the period January 1st 1988 – December 31st 1991.

Please note that I am NOT requesting patient medical records which would obviously be exempt, but administrative correspondence, letters and/or any other documentation including minutes of meetings etc.

Please supply material preferably in PDF format though any format will suffice in the interest of keeping costs / time to a minimum if this is easier.

Dear Mr/Ms Evans,

My colleagues have asked me to seek clarification of your use of capital letters in the word AND in your request below. Does it indicate that you are only interested in documents which not only refer to HIV / AIDS or Hepatitis, but ALSO refer to Haemophilia / Haemophiliacs in the same document?

Alternatively, do you want us to locate documents which refer to HIV / AIDS or Hepatitis in one search and to seek documents which refer to Haemophilia or Haemophiliacs in a separate search?

Thank you for your Freedom of Information request dated 18 August 2018, which has been handled under the Freedom of Information Act 2000 (FOIA).

Your request and our response are as follows:

I am writing to request under the freedom of information act any/all copies of administrative correspondence, letters and/or any other documentation including minutes of meetings etc that mention or relate to:

HIV / AIDS or Hepatitis, AND, Haemophilia / Haemophiliacs during the period January 1st 1988 – December 31st 1991.

Our response:

The requested information is not stored in a form which can be easily or quickly searched.

Board minutes and other corporate records from the period covered by your request are stored in hard copy binders in the trust's vault. They are organised by date and type of committee only, in blocks of five years. At this point, we are unable to say whether they contain references to the topics in question. The only way to search them for the information that you have requested would be to manually trawl through the binders, then to look at what would need to be redacted etc.

We estimate that the time that would be required to locate, identify, retrieve, redact and collate any documents which match the description above would exceed the appropriate limit set out in section 12 of the Freedom of Information Act 2000 of 18 working hours.

In accordance with section 12 of the FOIA, we are not obliged to comply with a request for information where the cost of compliance is estimated to exceed the appropriate limit set out by the Act.

Section 12 of the Freedom of Information Act makes provisions for public authorities to refuse requests for information where the cost of dealing with them would exceed the appropriate limit. The limit has been specified in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004. This represents the estimated cost of one or more persons spending 2 ½ days working days in determining whether the Trust holds the information, and locating, retrieving and extracting it. Under section 12 of the Act, we are allowed to refuse to handle the request if it would exceed the appropriate limit. The appropriate limit has been set by the Regulations (SI 2004/3244) as being £450 (equivalent to two and a half days work, at an hourly rate of £25).

I hope that the response that the Trust has provided is satisfactory.  However, if you are dissatisfied with the way in which your Freedom of Information request has been dealt with you can request an internal review. Please email [email address] within 40 working days with clarification of what you would like to be reviewed. We will aim to provide a review response within 20 working days.
