I am writing to request an internal review of Cheshire West and Chester Council's handling of my FOI request 'TRO Delamere St, Chester'.

Yet again CW&CC have failed to provide me with the requested information within the time frame as required by law, this type of request is not one that requires a lot of in depth searching, the information about TRO's needs to be ready available to members of the public should they wish to challenge a PCN that they believe to be wrongly issued, PCN challenges are time dependant and delays in providing the correct information could jeopardise the outcome of legitimate appeals. ]

2 requests were made on the 19th Feb, One for Delamere St and one that should not have been sent for Northgate st, The response relating to no further action was made as a response the Northgate st and not Delamere ST which still warranted a reply, I have asked What do they know to clarify the position

The messages sent by Cw&Cc are conflicting, One reply states That the original request was not received yet another reply quotes the email in a response, this plus a response from "What do they know" suggests the email containing the request was received,This being the case, why was my request for a internal review declined

The review request was referred to one of the Council’s solicitors,
Catherine Gaukroger who (prior to meeting to conduct a formal review with
one of the Council’s managers), has made enquiries about the response to
your original request for information i.e.
Please provide me with Traffic Regulation orders for Delamere Street
Chester. Please include any amendments, revocations, consolidation orders
and plans”.
 
That original request for information was made on 19 February (reference
1835766) and was due to be dealt with under the Environmental Information
Regulations. However, the Council treated it as cancelled after you
e-mailed FOI West on 24 February advising that this appeared to be a
duplicate request and that no further action was required.  Following
correspondence with FOI West, the request was subsequently confirmed and
logged as a new request on 24 March 2014 (reference 1907949)  A response
was sent on to you on 22 April and it is that response which you have now
asked to be reviewed.
 
The Council’s Principal Engineer has confirmed that  the permanent Traffic
Regulation Orders that are currently in operation on Delamere Street have
now been checked and are as follows:
 
The Cheshire West and Chester Borough Council (Prohibition and Restriction
of Waiting and Street Parking Places) (Civil Parking Enforcement and
Consolidation) Order 2013. This together with the plans from the Schedule
to this Order that relate to Delamere Street are attached below.
 
The City of Chester (Upper Northgate Street Area) (Traffic Management)
Order 1994. 
 
Since your  original enquiry this Order has been amended by:
 
The Cheshire West and Chester Borough Council (Upper Northgate Street
Area, Chester) (Traffic Management) (Amendment) Order 2014
 
The revoked TRO’s that relate to Delamere Street over the last 40 years
are as follows:
 
Cheshire County Council (Prohibition and Restriction of Waiting and Street
Parking Places) (Chester Area) (Consolidation) Order 2008
 
The City of Chester (Hamilton Place Area) (Prohibition of Waiting and
Loading) Order 1999
 
The County Borough of Chester (Delamere Street) (Prohibition and
Restriction of Waiting) Order 1973
 
Additionally, there are records of the following  temporary restrictions
for Delamere Street:
 
 
No other information has been found relating to your request.
 
The Council apologises for not sending a clear and accurate response
before now to your request for information about TROs for Delamere Street
. We now believe that we have answered your request in full. In view of
the information now given, we consider your request for a formal internal
review to be closed.  The email sent to you yesterday advising that a
formal review would take place on 18 June 2014 will not now go ahead.  If
you consider otherwise I would be grateful if you could advise within 5
working days stating your reasons.
