Dear Wiltshire Council Sharron Evans LLM, Principal Information Officer,Governance Team, Legal & Democratic Services,
I wish to see copies of the Legislation, Policies and procedures you rely upon relating to the periods of retention of sensitive personal data held by your social services department when a service user reports neglect, abuse and harm caused to him/her ? My request is prompted by your own response to a SAR I made ( 278 of 2012 ) on 22 08 12, that you eventually supplied the disclosure to on 02 11 12 ( 72 Days ), indicating ' Unless there are safeguarding issues, files are destroyed after a year ', yet despite meeting with Jill Jones and Lorna Bidgood and making a formal safeguarding alert on 22 08 2011 which took some 3 hours, the files were destroyed and I wish to see why ? I also enquired about Margaret Sheather who I understand chairs the adult safeguarding board and works WITH the Council in a paid role, but was told ' not a Council employee ' How do I obtain copies of very personal sensitive data, relating to neglect, abuse and harm I have suffered that I discussed at length in a pre arranged private meeting offered by Wiltshire Council with Margaret Sheather in Council Offices, where she stated she would not write anything down, but admitted these were very serious matters.Many months later, I still await her response, or anyone elses to the matters I reported ) I have suffered significant harm, a mental health injury due to the failings of a number of organisations and I ask you to make a ' reasonable adjustment ' under the Disability Discrimination Act / Equality Act so as to ensure I receive proper information and clarification of the matters ive raised. I do not wish any over defensive person in Governance Legal and Democratic Services or elsewhere in Wiltshire Council to act in a discriminatory manner towards me by refusing to be the open and transparent organisation that the leader of your Council Jane Scott claims you to be in the press. May I ask you to forward a copy of my request to George O Neill and James Cawley please. Will you also make me aware of the policies and procedures of how long you keep records of letters / faxes / emails sent in from members of the public, and how long you keep internal memos, emails/ notes sent between staff or people working with the council such as Margaret Sheather who you state is not a council employee, yet clearly holds a very important position and carries out work for the council. Will you also show me the policy/ guidance you issue to staff in relation of retention of these documents, and should someone delete a file of documents that maybe the council would prefer were never seen, but in Law should have been kept are you able to recover them ?

If you submit your subject access request to Wiltshire Council with
precise details of what you require we will endeavour to locate the
information. Please submit your request in writing to Wiltshire Council,
Governance team, County Hall, Bythesea Road, Trowbridge BA14 8 JN or to
[2][email address]. Please do not use this public website
for data protection enquiries.

No policy/guidance issued. Recovery depends on circumstances, time,
software etc. We have no recorded information which would answer this.

Dear Sharron Evans LLM, Thank you for your response to my FOI request, 19 working days after I submitted it. I note with regret that other FOI requestors receive an acknowledgement,even though there is no requirement for you to do so, but I didn't and I would like to know why I am treated less favourably ? I am disappointed the links mentioned in your response do not work - hence I cannot see the information I asked for. Did you attach the Legislation, Policies and Procedures I asked about? Did you copy my requests to George O Neill and James Cawley as I asked within my request ? Clearly I am very concerned that the details of my Safeguarding alert made on 22 08 11 - which identified abuse I was and still am suffering was destroyed . YOU Sharron wrote to me stating ' Unless there are safeguarding issues, files are destroyed after a year . My understanding is Mr K's percieved safeguarding issues are in the last year or so...' . That is why I have made this request for the Legislation/Policies and Procedures you relied upon to destroy my adult safeguarding alert identifying abuse in less than one year, or so ? May I make it clear, before Nina Wilton throws another wobbly, that I am asking you for assistance with my request as it would appear you have not provided the information ive asked for, and it appears to me the destruction of my file, at the time I had made a Subject Access Request, should NOT have happened as I had identified reportable abuse, made a formal alert, and reported the abuse to your senior Social Workers ? Did you Sharron personally see or read any part of the file that was destroyed ? I wish to establish the grounds on which you destroyed the file, and can it be recovered ?

I am in receipt of your Friday afternoon email of todays date, 44 DAYS after I made an FOI request to you regarding these matters. I asked to see copies of the Legislation, Policies and procedures you rely upon relating to the periods of retention of sensitive personal data held by your social services department when a service user reports neglect, harm and abuse caused to him / her. As at todays date, 44 days after my request you have not provided this information.
I asked you to make a 'reasonable adjustment' under the Disability Discrimination Act / Equality Act to help me, but you failed to do so.
I asked you to copy my request to George O'Neill and James Cawley - both your councils top people in regard to adult safeguarding as I am suffering multiple abuse- did you send copies of my requests to them as I asked ? I asked you about how long you keep internal memos, emails/notes sent between staff or working WITH the Council such as Margaret Sheather, but you did not give me this information. I asked for information sufficient to provide clarity in respect of policy/guidance regarding retention of documents should someone delete a file of documents that maybe the council would prefer were never seen, but in Law should have been kept - are you able to recover them. I do not feel your response adequately answers the question I asked, as I am trying to obtain clarification of the precise requirements the Council has to me in respect of documents you claim were destroyed at the time I made a SAR under DPA. I believe your evasive and unhelpful responses are abuse of me, and ask you to raise an alert under NO SECRETS please, and to email me to confirm you have done so. Under your response of 23 09 13, NONE of the numbered links you provided were 'live', I was unable to access the information you supposedly were providing. I refer you to " Data retention policy can be found ( 1 ) here ", that doesnt work, the same applies to (2) email address and (3) here. I had expected you to offer full reasonable assistance in respect of deleted data - with your personal knowledge of what I was referring to. On 23 09 13 I emailed you regarding the links that didnt work, asking if you emailed James Cawloey and George O'Neill as I asked. TWENTY FIVE DAYS after I emailed you on 23 09 13 with the above information, on 19 October, you emailed me again 44 days after my request, a response that contains spin abd is not a true reflection of the fact. THE LINKS YOU PROVIDED DID NOT WORK, THEY WERE NOT AND STILL ARE NOT LIVE and cannot be used. Your so called 'sorry' is in fact misleading spin - THIS IS WILTSHIRE COUNCIL FOR YOU ! You mention Carefirst and Caldicott principles - what are you on about - I do not have an LLM like yourself- please explain and send me supporting documents via a LIVE link - without further delay. You attached the FOI review procedure, and the P & P for Safeguarding Vulnerable Adults ( now described as 'an adult at risk' by leading councils and government bodies as this is seen as a more acceptable description by society now !DID YOU EMAIL JAMES CAWLEY & GEORGE O'NEILL AS I ASKED ??? You STILL have not sent me the Data retention policy indicated at 1 & 3, or a proper response to recovery of deleted records. Further to your email below.

I have spoken to Wiltshire Council's Adult Care advisors on 0300 456 0111 to raise a safeguarding alert as you requested. I have explained that you believe I am abusing you by not providing the information you have requested. They do not feel this is an appropriate issue to deal with under their procedure however, if you wish to contact them direct you are welcome to do so.

As I have explained previously, if you are unhappy with the council's response to your FOI request, or if you feel your personal information has not been properly dealt with, the correct procedure is to contact the Information Commissioner's Office. They are an independent body and will investigate the matter on your behalf. You can contact them on 0303 123 1113 or 01625 545745, http://www.ico.org.uk/complaints or write to Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF. All this information has been supplied to you in the council's review procedure.

The links I provided unfortunately appeared to be inaccessible to you. They link to the council's general Data Retention Policy. I was however, able to locate information relating specifically to the service concerned and provided that in my email to you on 18th October.

Carefirst is the recording system used by Adult Care.

A Caldicott Guardian is a senior person responsible for protecting the confidentiality of patient and service-user information and enabling appropriate information-sharing. The Caldicott Guardian for Wiltshire Council is Iain Kirby, Head of Business Change. He has supplied the attached short presentation that he uses to explain what Caldicott is. It covers a little of the background, the revised principles and the role of the guardian.

I have apologised for the delay in responding to your request. I have explained that we are extremely short staffed and have been unable to comply with the required deadlines because of the volume of work we have.

As explained several times, I cannot deal with issues other than the requests under FOI and EIR so have not forwarded your emails. You have been in contact with those officers previously and are aware of how you can contact them directly. You will also be able to discuss the personal issues with them rather than on this public site.

I have read and been told that even taking away a persons Rights in Law is a form of abuse that is reportable - but I suppose I have to take into account it is Wiltshire Council I am dealing with , and maybe that now happens so regularly WC considers itself above the Law and CHOOSES to ignore abuse of ' at risk ' residents of Wiltshire ? In para 2 of your response, you state -" the correct procedure is to contact the information commissioners office ". I am confused as the document on WC headed paper you sent me " Review Procedure for Information Requests " indicates I should write to the principal information officer at WC asking for a review. You have therefore guided me to two different processes , having spoken to the ICO office today, they tell me WC must go through their own review process first - so it appears you were attempting to send me on a wild goose chase , by deliberately misleading me ? Regarding the links AGAIN ! , the NUMBERED links are inaccessible to EVERYONE, although in previous disclosures on different subjects from you they have worked ok. I shall need to submit a further request to gain a full explanation of your statement, as I am fully aware under FOIA Legislation the ICO regularly provides help and assistance in respect of questions asked and information being passed to different departments for a response that are linked in some way to FOI requests submitted to him, they state they have a duty to do so. I shall need to clarify how you can talk to adult safeguarding when I ask you to raise an alert - but cannot copy an email to senior figures in adult safeguarding when I ask you to do so ? I look forward to seeing the policy you are using for guidance when responding in the way you do !
From talking with the ICO office, I am sorry to hear of the numbers of adverse decisions the Information Commissioner has made in respect of FOI & Data Protection at Wiltshire Council !

        I will respond to this part of your request by post. This website

        Your legal rights have not been removed. You have been informed of
the correct route to follow if you are not happy with the council's
response to your requests for information.

        I attach a copy of the Data Retention Policy from 2008 which has
now been superseded by an electronic version it appears you are
unfortunately unable to access. I have attached the master document
for         the electronic system which, as you can see, does not easily
provide the information you have requested. In light of this, I contacted
the specific service responsible for holding that information and was    
provided with the information I then supplied to you.
 
I trust you will be in a position to advise me, with your LLM in place, if
I should go straight to the ICO as you told me or if I firstly need to
activate WCs review procedure first ? Please be totally clear in your
response, in plain English without lies or spin, and answer to each of the
matters ive raised in this email to you, as soon as possible please due to
the lengthy delays ive experienced in moving towards an acceptable
standard of service from you.
 
        If you are dissatisfied with the response the council has given,
you can contact the council for a review. If you remain dissatisfied you
can then contact the Information Commissioner’s Office. The council’s
review   procedure states that an officer who was not originally involved
in processing your request will conduct the review.
 
        Although your request has been reviewed it may not have been
clearly explained that that has happened. The review was not dealt with by
another officer in this case. I dealt with your original request and with
your   review. This was due to a temporary shortage of experienced and
available staff who could carry out a review, and that your previous
correspondence has been vexatious. Although not strictly in line with our
usual     procedure I determined that this was probably the best course of
action rather than delay dealing with your review until another officer
was available. I am sorry that was not clearly explained at the time.
 
        You have two options at this point, you can ask the council to
review your request again by another officer, or you can go directly to
the ICO and explain that the review has already been carried out.
 
You refer to the Caldicott Guardian - thank you - but ive carefully looked
at this email response, but nowhere can I see the " attached short
presentation " you refer to, I know Im very ill, but am I being thick ?
One starts to doubt oneself when Im ill when people say something is in
front of me but I cannot see it ?
 
        I attach the presentation, it appears I omitted to attach it
correctly last time, for which I apologise.

own case maybe if you and others had the ability to get it right the first
time, then your workload would reduce and the members of the public would

FINALLY, clearly you are a senior highly qualified member of WC staff, and

emails ". I shall need to submit a further request to gain a full
explanation of your statement, as I am fully aware under FOIA Legislation
the ICO regularly provides help and assistance in respect of questions
asked and information being passed to different departments for a response
that are linked in some way to FOI requests submitted to him, they state
they have a duty to do so. I shall need to clarify how you can talk to
adult safeguarding when I ask you to raise an alert - but cannot copy an
email to senior figures in adult safeguarding when I ask you to do so ?  I
look forward to seeing the policy you are using for guidance when
responding in the way you do !
 
        There is no written policy for this matter. The council expects
officers to raise an alert if they believe there is a safeguarding issue.
The standard contract of employment contains the following:
 
                ‘Safeguarding
                Wiltshire Council is committed to safeguarding and
promoting the welfare of Children, Young People and Vulnerable Adults. You
will be expected to report any concerns relating to the safeguarding
of            children, young people or vulnerable adults in accordance
with agreed procedures.
 
                If your own conduct in relation to the safeguarding of
children, young people or vulnerable adults gives cause for concern the
Council’s agreed Child Protection or Vulnerable Adult procedures will
be          followed, which may include implementation of the
Disciplinary Procedure. ‘
 
        As you had directly requested I raise an alert, I did so, even
though I believed it was not the correct approach for resolving the issues
you had identified. I contact other teams for information in order to
respond to a     request. This is separate from passing messages on your
behalf to officers you specify regarding ongoing issues you have with
them.
 
 
From talking with the ICO office, I am sorry to hear of the numbers of
adverse decisions the Information Commissioner has made in respect of FOI
& Data Protection at Wiltshire Council !

Dear Sharron Evans LLM - WC, thank you for your letter dated 31 10 13, received today in respect of my above query in the first paragraph of my email above dated 22 10 13. I am sorry to see you did not keep any notes of the conversation you had. I was again disappointed at how Susan Wells ( whoever or whatever she may be as no indication is given that shows which department she works in ) has recorded your contact with her in such an unclear and disingenuous manner - " Due to the information Sharon " ( sorry but Susan Wells spelt your name incorrectly ! ) " was unable to provide ( confidentiality etc ) , he says he is unhappy and because of this, believes he is a vulnerable adult "[exteranous personal material removed] She refers to " V.A. " , " C.A. " , and S A M C A T , but I have no idea what these letters mean, and wonder despite my asking about this information within a Freedom of Information request, then you choosing to deal with my request for clarification regarding one matter in the FOI request, as a subject access request ( SAR 368 ) ! I am contacting you as you indicated in your short letter if I was unhappy with what has been provided I should contact you - so I am. May I thank you for speaking with Susan Wells about my safeguarding alert on Monday 21 10 2013 - you should know the NO SECRETS booklet and policy ( WC are lead signatories to that document ) indicates EVERYBODY in your Council has a DUTY & RESPONSIBILITY to raise a Safeguarding Alert without delay once they have become the 'alerted person', which of course YOU and Susan Wells are. It concerns me therefore that what you tell me, and your lack of formally raising the alert I made to you, does not conform with the NO SECRETS booklet or Policy you should be using. I have yet to hear from the safeguarding team regarding the alert I made to you - and no notes kept by you that confirm I made that alert to you ????? I trust you will be in a position to deal with the matters ive mentioned here, and of course to provide the information I asked about in my FOI request in a format that I can actually access and read .
