FOI Request Ref:  13/0960

Dear Mr Smith,

FREEDOM OF INFORMATION ACT 2000: FOI REQUEST  13/0960

Thank you for your email of 21 July 2013 where you requested details on
the number of Wayleave agreements in place in England and Wales

This request for information is being handled under the Freedom of
Information Act 2000.

Under the Freedom of Information Act 2000 ('the Act'), you have the right
to:

·        know whether we hold the information you require
·        be provided with that information (subject to any exemptions
under the Act which may apply).

Our response to your request for information is given below.  If you have
any queries then please contact me quoting the above reference number.

Please could provide me with the number of Wayleave agreements that are in
place in England and Wales that compensate the landowners who have high
voltage cables or lattice pylons on their property?

The Department does not hold the information you require. Wayleaves for
electricity apparatus are primarily voluntary agreements made between
affected landowners and occupiers and electricity companies requiring to
install new overhead lines or to retain existing overhead lines over land
they do not own.  The Department is not involved in this negotiating
process between parties.  The Department’s involvement only comes to the
fore when voluntary agreement cannot be reached between parties and the
electricity company applies to the Secretary of State under a statutory
process for a necessary (compulsory) wayleave to retain or erect its
equipment on the said land.

In our recent consultation on proposals for Electricity Act wayleave
reform see:
[1]https://www.gov.uk/government/uploads/sy...
the Department estimates, following informal discussions with Distribution
Network Operators, that most Operators have between 150,000 and 500,000
wayleave agreements to manage on an ongoing basis with continual churn as
property ownership changes.

Appeals Procedure
If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
