Dear Environment Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Environment Agency's handling of my FOI request 'Chalenges to commercialisation of Osney dry dock'.

The refusal to share appropriately redacted information in my view uses reasons not rightly applied in this case. It would if companies applying or figures were mentioned that could effect the bidding process.

The E.A. states "We are unable to separate out information for release from material which we are currently treating as confidential."

It is not nessasary to seperate out information with this request. Redaction of a non excessive type would serve the public interest especially as I know learn the E.A. has been working on this commercialisation idea for the dry dock since 2006 and has employed a outside consultant.

I shall be applying to the Information Commissioner to this case in 20 working days if your response is not satisfactory to me whom I think i should say has decided only in my favour previously re redaction of records.

The internal review goes some way to addressing the FOI request but not i think far enough. I guess a complaint to the ICO is likely.

We have not got to the stage of a planning application yet.  It appears we
may need planning permission if we lease out the Dry Dock, the Local
Authority seem to be taking the view if we the EA give control of the dry
dock (Lease) to anyone else it constitutes a planning change of use, not
withstanding either way the dry dock will still be used as a dry dock.

 

My comments above are an over simplification, the issue hinges on the fact
as a statutory body the EA has what can  be described as automatic user
rights and once we pass occupation to anyone else they need planning. The
planning law in this area is to say the least complicated, but I’m hopeful
the matter will soon be resolved and if it is deemed necessary we will
submit a planning application, at which point you or any other interested
party can make comments.

 

This planning issue came out of the blue and was not expected, and as you
know has delayed bringing this matter to the market , much to the
annoyance of all, be assured I’m applying as much pressure as I can  and
either myself or Phil will let you know when we can move on to next stage

 

This process has been far more involved than expected and I’m therefore
reluctant to put a time scale on it, I will keep you posted when the
planning issue is resolved.

Dear E.A. People,

The idea to allow private persons to use an under used dry dock was forwarded in 2006. When are you applying for the planning permission and what other work is required? Is the idea to go to tenders with a private operators? Reluctance to give an indication of the timing of dry dock public use progress of the future is in my view a really poor idea as the consultancy fee's acrew.
This new FOI request ask's for the past years and future process documentation to be made available here with proper redaction if nessacary. I am delaying and potentially cancelling a ICO complaint if a prompt response is given.
