Enfield Homes Encroachment of Land

We are deeply dismayed that after 4 month request, Hertfordshire Council has failed to clarify or advance any opinion, regarding the encroachment by the London Borough of Enfield within Hertfordshire Land.

Request Freedom of Information Disclosure.
Relating to all hard copy, data and communication records with the London Borough of Enfield (Enfield Homes Almo) claim to Hertfordshire land,as advised your Mr Warby Asst Asset manager.
Being Hertfordshire Highways land, the verges A1000 & B556 Mutton Lane, Potters Bar. Hertfordshire. That Enfield has since November 2012 provided tree service maintenance, with expenditure, though all over services provided by Hertsmere or Hertfordshire Councils within this land boundary. Without having any historical association evidence, of any title, or interest in this land ever before.

the extent of highways officer who has been carrying out extensive
research into your query and the Highways Officer who has been in regular

 I expect to be able to provide a full response early next week.  As you
may be aware Potters bar was part of Middlesex until the mid 1960's and
several different local authorities have had responsibility for housing,
therefore it hasn't been a simple matter to unpick the responsibility you
are querying.

 

However in order to answer part of your enquiry, I can confirm that
Hertfordshire County Council does not hold any information  with regard to

I understand that a full response has now been sent to you. For reference
I have included here the descriptive text but not the 14 attachments.

 

In the light of this response, I would be grateful if you would confirm
whether you wish us to proceed with an internal review? If I do not
receive confirmation I will assume you no longer require the internal
review. However if you are not satisfied with your response we will
conduct an internal review as described at the bottom of this letter.

 

In response to this enquiry, please find attached a plan showing the areas
of land at this location which are considered to be highway maintainable
at public expense coloured yellow.  (Attachment No 1)  The County
Council's opinion on the highway status of these areas of land rests on
the Inland Revenue map IR/522 (produced in accordance with the Finance
(1909-1910) Act) which shows these lengths of roads being uncoloured. 
This is strong evidence that highway rights were considered to exist at
that time, over these areas of land.

 

An extract from this Revenue map is also attached for your information. 
(Attachment No 2)  The original map may be inspected at the Hertfordshire
Archives and Local Studies (HALS) at County Hall.

 

It should be noted that, at that time, the residential development now
owned by the London Borough of Enfield (formerly the Edmonton Borough
Council) was not in existence.  Furthermore, prior to the introduction of
the London Government Act 1963, this part of Potters Bar was situated
within the County of Middlesex.  It  was only transferred into the County
of Hertfordshire on 1st April 1965 when the provisions of this Act came
into effect.

 

Following extensive research through the committee minutes of Potters Bar
Urban District Council (Potters Bar UDC) at HALS, it would appear that on
20th November 1952 the Edmonton Borough Council made a Compulsory Purchase
Order under Section 74 of the Housing Act 1936 to acquire land within the
Urban District of Potters Bar for development purposes.  At that time,
this proposed development was known as "Potters Bar Farm" and comprised of
Field Nos 646; 647, 648, 649, 672 and 673 as shown on the 1935 Ordnance
Survey map of Middlesex (Sheet No 1/12).  (Attachment No 3)  A copy of
this 1935 Ordnance Survey map is also attached with the areas of land in
question edged in green.  (Attachment No 4)  It is considered that this
development which was subsequently transferred by Edmonton Borough Council
to the London Borough of Enfield (as its successor following the
reorganisation of the municipal London Boroughs in 1965) is the subject of
Mr Rodwell's enquiry.

 

For reference purposes, the area edged green from the 1935 Ordnance Survey
map has been transposed onto the present day Ordnance Survey map which
clearly defines the extent of the London Borough of Enfield's housing
development  (Attachment No 5).

 

With reference to the committee minutes of Potters Bar UDC, it would
appear that at their meeting held on 16th December 1953, a request was
made by Edmonton Borough Council to Potters Bar UDC for their approval to
the layout of this development.  This layout was agreed in principle
subject to an increase in the minimum width of some of the roads on the
estate.  (Attachment No 6)

 

At its meeting held on 5th May 1954, Potters Bar UDC were informed that
the construction of the roads and sewers on the estate had commenced and
it was resolved that the roads and sewers on the estate could be "taken
over" (commonly known as being "adopted") in stages.  It was also resolved
that Potters Bar UDC were willing to plant the trees on the estate (at
Edmonton Borough Council's expense) , but a decision on the future
maintenance of the grass verges on the estate would be deferred for
consideration at a later date.  (Attachment No 7)

 

Since the planting of any trees would be upon these areas of grass verge,
it is considered that the question of the maintenance of these trees would
also form part of any future decision made by Potters Bar UDC.

 

At its meeting held on 14th September 1955, a resolution was made by
Potters Bar UDC agreeing to the suggested street names for the roads on
this estate.  (Attachment No 8)  These road names correspond to those
shown within the green edged land on the present Ordnance Survey map. 
(Attachment No 5)

 

At its meeting held on 11th February 1959, notification was given to
Potters Bar UDC that all the works on the above estate roads had been
satisfactorily completed and a formal request was made by Edmonton Borough
Council for these roads together with certain lengths of footways
connecting these roads to be formally adopted.  (Attachment No 9)

 

These roads and footways are shown coloured light green for reference
purposes on Attachment No 10.

 

It should be noted that the above committee resolution refers to the
adoption of the roads and footways on the estate.  It makes no mention of
the adoption of any grass verges nor the trees planted on these verges.

 

This office provides information on the extent of highway maintainable at
public expense based on the documentary evidence to support that claim and
even searching through the committee minutes of Potters Bar UDC post the
adoption date for the roads and footways has found no reference to the
possible dedication/adoption of the grass verges (and trees) on the
estate.  Therefore, on this basis, and in the absence of any documentary
evidence to the contrary, these areas of grass verges (and associated
trees) do not form part of the highway maintainable at public expense. 
These areas of land are shown coloured pink on Attachment No 11 

 

I would also mention that from previous investigations, the Borough of
Edmonton also built housing developments within the Cheshunt and Waltham
Cross areas in the 1950's.  With reference to the associated committee
resolutions, it was resolved that the grass verges on these housing
estates would not be adopted and consequently responsibility for the
maintenance of these grass verges would remain with Edmonton Borough
Council (now the London Borough of Enfield).  (Attachment Nos 12 and 13)

 

From my investigations, it would appear that Potters Bar UDC adopted the
same approach in respect of this Edmonton Borough Council housing
development within their district.

 

It is also evident from the 1968 Ordnance Survey map that the public has
gained uninterrupted pedestrian access over the length of footway situated
on the southern side of Mutton Lane shown coloured yellow (hatched black)
on the plan for many years.  In this instance, sufficient time seems to
have passed for dedication to be presumed.  The Highways Act 1980 have
presumed dedication after twenty years and the courts have presumed
dedication after periods as short as seven years.

 

In conclusion, it is considered that the areas of land shown coloured
yellow; yellow (hatched black; and light green on Attachment No 14 are
considered to be highway maintainable at public expense and in this
respect should be maintained by Hertfordshire County Council, as highway
authority.  The areas of land shown coloured pink on the plan are not
considered to be highway maintainable at public expense and in this
respect should be maintained by the London Borough of Enfield as land
owner.

Dear Information Governance,
Yes the internal review still required, further to the outstanding FOI requests, and subsequent chasing.
I am still awaiting this information within the WhatDoYouKnow FOI system.

I have received no relevant response as to my official request dated 1st April 2013. Being that Enfield Homes on the behalf of Enfield Council have encroached your land, for the very first time, commencing within the year 2012. The information as requested as to the presence of Enfield Homes, contracting Enfield expenditure within your boundaries.
Enfield Homes only funding one service being tree maintenance. on land still today being fully maintained by Hertfordshire Highways, including tree maintenance in apparent duplication. This despite Hertfordshire who have always provided all road traffic services, including speed cameras, grass cutting, surrounding parking zones, bollard fitting, road and verge cleaning, and repair, traffic signs to both sides surrounding and within the encroached land. Also all Utility companies work being legally mandated by Hertfordshire not Enfield.

Hertfordshire must have data and documentation relating to this recent only presence of another councils representative, performing concurrent financed tree maintenance work, within the otherwise always known Hertfordshire land. This within a fully serviced area fully controlled by Hertfordshire.

I request all information pertaining to today’s current land registration legality, and all communications between Hertfordshire highways and Enfield Homes, within the period 2012/13. This being applicable to the initial apparent encroachment, of the land already financed with full services, already being provided fully by Hertfordshire Council.

All of which all services are still being provided and continued by Hertfordshire today.?

Please provide 2013 information response, 1954 minutes have no relevance to my request.
