FREEDOM OF INFORMATION REQUEST REFERENCE 0612/2012 
 
I refer to your request for access to information made under the terms of the Freedom of 
Information (Scotland) Act 2002 namely; 
 
 “Can you confirm that information received by Strathclyde Police from a concerned 
member of the public in Glasgow led to the launch of Operation Tharsley in 2012”
   
 
I refer to the response dated 17 September 2012 from Lorna Grieve of the Freedom of 
Information Unit that referred to Section 18 of the Act being that Strathclyde Police can 
neither confirm nor deny that it holds the information requested by you.  I note also that Ms 
Grieve informed you that if the information was held by the Force, it would be considered 
exempt in terms of one or more of the exemptions detailed in Section 18 of the Act, which are 
listed below: 
 
•  Section 34 – Investigations by a Scottish Public Authority 
•  Section 35 – Law Enforcement 
•  Section 39(1) – Health Safety and the Environment 
 
I refer to your request for a review of that decision detailed in your email of 18 September 
2012. 
 
In accordance with the Act, a Review Panel convened on 10 October 2012 to consider your 
request for a review of the decision. 
 
The Panel noted the content of your email dated 18 September 2012. The Panel also noted the 
explanation provided to you by Ms Grieve in the response letter of 17 September 2012.   
 
I can inform you that in terms of Section 21(4)(a) of the Freedom of Information (Scotland) 
Act 2002, the Panel has upheld the terms of the decision made without modification. 
 
If, after receiving the decision of the Panel, you are not satisfied, you are entitled to make an 
application for decision to the Scottish Information Commissioner, Kinburn Castle, 
Doubledykes Road, St Andrews, Fife FY16 9DS, telephone number 01334 464 610.
