Please can you provide me with the following information.

1. List of positions within the council that as part of their role either enforce or contribute to Information Governance (including, but not limited to, Data Protection, Freedom of Information, Environmental Information Regulations, IT Security etc).

2. Copies of minutes for your governance groups that have responsibility for or contribute to Information Governance with a copy of their Terms of Reference.

3. Copies of your current policies that reference or directly govern Information Governance and/or Security
within the council.

Minutes, terms of reference and position structures should be kept centrally as part of your Audit requirements. Policies should be available via an intranet according to ICO practical guidance. If you apply a section 12 exemption (cost or time limit) I recommend this is highlighted to your audit department as a Governance and Audit compliance risk.

Please note, with regards to your internal review for the handling of my request outlined by K McGough I am happy with your determinations and agree with your interpretation of the Act.

However, following on from your response outlining your application of section 40, 36, 31 and 30 to information I have requested I wish to appeal this decision. Please note, under ICO guidance and in accordance with the Section 45 code of practice I have the right to only appeal this decision once to yourselves therefore please can you ensure this is reviewed at the appropriate level.

Section 30 & 31 exemptions; you have implied that the minutes in their entirety are exempt from disclosure however you have not confirmed that. Nor have you made the case for or against issuing a redacted copy with the relevant information you wish to withold redacted. Therefore you have not complied with the requirements under Section 30 and 31 and ICO Awareness Guidance Number 3. Please can you ensure that your response outlines the case both for and against issuing a redacted copy of minutes. Please also confirm which documents are covered by this exemption and for which boards.

In your application of Section 36 I recommend that you look at what other local authorities have released on this subject matter (Kent County for example) as they disclosed in full. Therefore can you also outline why other organisations are able to disclose this information with similar membership and yet Essex does not? Given that this area is around the handling of personal data not belonging to yourselves there is a strong interest for knowing what decisions are being taken about that data, a view point which is shared by other councils.

Section 40; please can you confirm to whom the personal data relates (staff or non staff) so that your assessment of breaching the 1st principle is clearer. Disclosure of citizen data is a clear breach of the 1st principle however, as you are aware, depending on who the staff are depends on whether the 1st principle is applicable. This is something you have not outlined clearly, also in breach of the FOI requirements to be clear about your exempts to assist the requestor.

In my request I also requested all roles that relate to Information Governance etc. For the most part this was honoured (thank you) however in a recent FOI request on here there is information from an "Information Risk" team within ECC. As this falls within that remit can you confirm why they were exempt from this request?
