'I have recently tested several Council scanning machines, in order to find the one which offers the best quality of scanning and I perceive that the machine I have chosen appears to produce documents of a much better quality than previously experienced. This is obviously excellent news and a facility I shall continue to avail myself of.'

Thank you for your request below, Wirral Council can provide the
information you have requested the department of adult social services
team brief newsletter is a current ongoing regular communication briefing
(every 2/ 4 weeks).  Please find attached briefing notes, with regard
inclusion of names in the documentation attached, any names of non senior
managers; volunteers or members of the public have been redacted.  This
has been done with consideration given to The Data Protection Act 1998 and
good practice.  The first issue is 20.02.2011, if you are unable to open
attachments please do contact.

Thank you for the information disclosed on the 29th May 2012.

You state 'any names of non senior managers; volunteers or members of the public have been redacted. This has been done with consideration given to The Data Protection Act 1998 and
good practice.'

I am not privy to the advice of which is given to you which seems to come from the Department of Adult Social Services which seems to be a misinterpretation of the Data Protection Act 1998 in that officers will not be named in minutes of meetings and now in newsletters. I am unsure over what good practice guide you are following however I would raise the following points to you.

This is a blatant misinterpretation of the act. Disclosing an officers name in the professional capacity is not protected personal data covered in the data protection act.

1.They are mentioned in their professional capacity
2.They are being paid by the local authority
3.They are directly funded by tax payers
4.They are public servants
5.The information is meant to be disclosed under the Freedom of Information Act 2000
6.You apply this apparent protected private information caveat only to junior officers where if it actually was protected private information then it would apply across the board rather than inconsistently as applied by WBC.

Good Afternoon,

This email constitutes the Internal Review conducted by the Council in
response to your request below.  The Council apologises for the delay in
responding to you.

 

The Council provided 38 sets of briefing notes to you with junior staff
members; members of the public and volunteers names redacted.  I consider
that the information you are seeking which the Council redacted in our
original reply i.e. information naming junior staff; members of the public
and volunteers is exempt from disclosure under Section 40(2) of the
Freedom of Information Act 2000.  This is because the information in
question constitutes personal data in that disclosure relates directly to
living individuals and disclosure of this data would contravene the first
data protection principle.

 

Contravention of the first data protection principle would occur as it
requires that personal data shall be processed fairly and lawfully and
shall not be processed unless at least one of the conditions in Schedule 2
of the Data Protection Act 1998 is met.  I do not consider that any of the
conditions in Schedule 2 would be met for the processing of this data.  I
believe you have already contacted the ICO and the Council awaits any
further correspondence from them on this matter.
