Dear Mr Moore,

I am writing in response to the following request for information made on 22nd February 2012.

" Proofs of Evidence of Nigel Johnson with appendices NJ1 & NJ2 in the 2006 case of BW v Kennet District Council, Appeal Ref: APP/E3905/C/06/2019638."

I am pleased to attach copies of the following documents for you now, the Proofs of Evidence of Nigel Johnson, appendix NJ1 and appendix NJ2.

Please note that we have redacted any personal information relating to third parties from the enclosures and document MB9 (Table of responses to BW's Letter to Lady's Bridge Moorers) is not enclosed as the information contained within this document represents personal data and is protected by the Data Protection Act 1998. As such it is exempt from disclosure under section 40 of the Freedom of information Act 2000.

Commercially sensitive information has also been redacted from MB6 (BW's Lease to Lady's Bridge Moorings Ltd) as it is exempt under section 43(2) of the Freedom of Information Act 2000. This is because the information withheld would or would be likely to, if disclosed, damage the commercial interests of BW and third parties. Furthermore, the public interest in maintaining this exemption outweighs the public interest in disclosing the information. The reasons for this is that a very substantial part of BWs overall revenues required to support its public activities are derived from competitive commercial activities. A risk of loss or reduction of revenues available to be spent on the public functions of BW would be contrary to the public interest.

If we haven’t reasonably met your expectations in relation to a request for information or you believe we may not have acted in accordance with the above legislation you should write in the first instance to Kelly Radley Head of Customer Relations, 64 Clarendon Road, Watford, Herts WD17 1DA outlining your concerns and asking for a review to be undertaken.
