This Housing Association is not subject to the Freedom of Information (Scotland) Act 2002. The Scottish Information Commissioner has decided that Housing Associations are public authorities for the purposes of the Environmental Information (Scotland) Regulations 2004
They have indicated that they do respond to reasonable requests for information, in the spirit of the Act: "GHA's openness and confidentiality policy states that; "Although not bound by the Freedom of Information Act (which currently does not extend to RSLs), GHA is not bound by, but aims to meet the spirit of the legislation."
Please note that you will not be able to complain to the Scottish Information Commissioner if you are dissatisfied with their response, unless it is a request for Environmental Information.
The Scottish Government has proposed to formally extend the FOI laws to GHA, this is still under discussion.
