Dear Sir or Madam,

What safe guards are in place to stop NI number being issues to
young people who are presently living (illegally) and receiving
state Education in the UK? From being issued with NI numbers?

This request has been put to the DWP who have informed me that is
would be your policy area.

You asked

"What safe guards are in place to stop NI number being issues to young
people who are presently living (illegally) and receiving state Education
in the UK? From being issued with NI numbers?"

HMRC issue National Insurance numbers (NINOs) to all young people aged 15
years and 9 months who are getting child benefit paid for them. This
happens when a scan of the child benefit system identifies that the young
person is approaching age 16, a NINO is then registered on our National
Insurance and Pay as You Earn system (NPS) and a plastic card posted out
to the young person.

Parents/carers of a child apply for child benefit by completing a claim
form and sending it to Child Benefit Office (CBO) together with the
child's birth certificate to act as evidence of the child's identity.
Since 2000 the claimant is required to have a NINO or provide sufficient
evidence of identity to allow a NINO to be allocated. DWP are responsible
for the security of processes allocating NINOs to adults.

HMRC confirms identity for children in child benefit cases by checking all
birth certificates, including foreign documentation for non UK national
children, before making an award. This includes checks against databases
of lost and stolen birth certificates

When an application for child benefit is received from a foreign national
they are required to provide employment and liability information to
enable appropriate checks to be conducted. This includes examination of
passports to confirm immigration status.
