the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances South Yorkshire Police may be unable to

Thank you for your request for information in relation to:

certain cases by supporting SSD's observations when they are wrong

Please could you clarify the following: -
Your correspondence does not contain a request for specific information.
The offence of ***Perjury*** is defined under Section 1 of the Perjury
Act, 1911: -
***If any person lawfully sworn as a witness or as an interpreter in a
judicial proceeding willfully makes a statement material in that
proceeding, which he knows to be false or does not believe to be true, he
shall be guilty of perjury, and shall, on conviction thereof on
indictment, be liable to penal servitude for a term not exceeding seven
years, or to imprisonment . . . [2]F1 for a term not exceeding two years,
or to a fine or to both such penal servitude or imprisonment and fine.***
This is a serious offence, triable on indictment only before the Crown
Court.
Your correspondence appears to be in the nature of an intimation that
South Yorkshire Police have failed in their duty to investigate an offence
of Perjury. If you have evidence or information that such an offence has
been committed may I suggest you contact and make a complaint/report to
your local Police Station or the Police station responsible for the area
in which you allege the offence was committed.
If you have a complaint to make about the actions or otherwise of a member
of South Yorkshire Police you can make it in person at any Police Station
or in writing either to the Chief Constable or, more properly, to: -

As things stand your ***request*** is not actionable in terms of
compliance with the Freedom of Information Act. It would be helpful if you
could specify what recorded information you require giving as much detail
of the issue giving rise to your request.
Please forward your clarification to South Yorkshire Police as this
request will be ***stopped*** on our database until this has been
received.
Once we have received clarification, your request be considered and you
will receive a response within the statutory timescale of 20 working days
as defined by the Act, subject to the information not being exempt or

Dear Mr Eskriett,
Unfortunately you do not appear to have provided any clarification in
respect of your initial correspondence. As such the matter has been
'stopped' within the 20 days as specified in the Freedom of Information
Act.
As I explained in my e-mail of 25/06/2009 the Freedom of Information Act
(FOIA) places a duty on Public Authorities to release RECORDED information
upon request. Your initial correspondence did not contain any specific
request for information and as such could not be processed under FOIA.
Your correspondence did however intimate that you had information or
concerns regarding the failure of South Yorkshire Police to comply with
its duty to investigate the possibility that agents or staff of another
Public Authority may have committed serious criminal offences. If this is
the case and you do indeed have information, evidence or suspicions as
such then I can only advise you, as previously, to report the matter to
your local Police Station or the Police Station responsible for the area
in which you believe the offence may have been committed.
If you have a complaint to make about the actions, or lack thereof, of a
member of South Yorkshire Police then you can make it in person at any
Police Station or in writing to the Chief Constable or, more properly, to:

They've asked for clarification, so the FOI clock stops until this is provided... The ICO won't consider an appeal until all internal complaints processes with SYP have been gone through.
They said:
